When is theanti-dumping duty applied in Vietnam?

Based on kết quả bóng đá trực tiếp provisions stipulated in Clause 2, Article 12 of kết quả bóng đá trực tiếpLaw on Export and Import Duties 2016regarding kết quả bóng đá trực tiếp principles of applying anti-dumping duties as follows:

Anti-dumping duty

1. Conditions for applying anti-dumping duty:

a) kết quả bóng đá trực tiếp imported goods are dumped in Vietnam and kết quả bóng đá trực tiếp dumping margin must be specifically identified;

b) kết quả bóng đá trực tiếp dumping of goods causes or threatens to cause significant damage to kết quả bóng đá trực tiếp domestic industry or hampers kết quả bóng đá trực tiếp establishment of a domestic industry.

2. Principles for applying anti-dumping duty:

a) Anti-dumping duties shall only be applied to kết quả bóng đá trực tiếp extent necessary and reasonable to prevent or limit significant damage to kết quả bóng đá trực tiếp domestic industry;

b) kết quả bóng đá trực tiếp application of anti-dumping duty is implemented when an investigation has been conducted, and it must be based on kết quả bóng đá trực tiếp conclusions of kết quả bóng đá trực tiếp investigation according to legal regulations;

c) Anti-dumping duty is applied to goods dumped into Vietnam;

d) kết quả bóng đá trực tiếp application of anti-dumping duties must not harm domestic socio-economic interests.

[1] In cases where kết quả bóng đá trực tiếp commitment described in Clause 2, Article 81 of kết quả bóng đá trực tiếpLaw on Foreign Trade Management 2017is not achieved, after kết quả bóng đá trực tiếp investigation concludes, kết quả bóng đá trực tiếp Investigating Authority announces kết quả bóng đá trực tiếp final conclusion on kết quả bóng đá trực tiếp investigation contents stipulated in Article 80 of kết quả bóng đá trực tiếpLaw on Foreign Trade Management 2017.

[2] Based on kết quả bóng đá trực tiếp final conclusion of kết quả bóng đá trực tiếp Investigating Authority, kết quả bóng đá trực tiếp Minister of Industry and Trade issues a decision on whether to apply anti-dumping duties;

[3] kết quả bóng đá trực tiếp anti-dumping tariff must not exceed kết quả bóng đá trực tiếp dumping margin stated in kết quả bóng đá trực tiếp final conclusion;

[4] kết quả bóng đá trực tiếp duration for applying anti-dumping duties shall not exceed 5 years from kết quả bóng đá trực tiếp date kết quả bóng đá trực tiếp anti-dumping duty application decision becomes effective, except in cases of extensions as specified in Clause 2, Article 82 of kết quả bóng đá trực tiếpLaw on Foreign Trade Management 2017, specifically:

- 1 year before kết quả bóng đá trực tiếp end of kết quả bóng đá trực tiếp application period of anti-dumping measures, kết quả bóng đá trực tiếp Minister of Industry and Trade issues a decision to conduct a final review on kết quả bóng đá trực tiếp application of anti-dumping measures;

- kết quả bóng đá trực tiếp purpose of kết quả bóng đá trực tiếp review is to determine kết quả bóng đá trực tiếp necessity, reasonableness, and socio-economic impact of continuing kết quả bóng đá trực tiếp application of anti-dumping measures;

- Based on kết quả bóng đá trực tiếp review results from kết quả bóng đá trực tiếp Investigating Authority, kết quả bóng đá trực tiếp Minister of Industry and Trade decides on whether to extend or not extend kết quả bóng đá trực tiếp application of anti-dumping measures;

d) kết quả bóng đá trực tiếp final review period is not more than 9 months from kết quả bóng đá trực tiếp date kết quả bóng đá trực tiếp review decision is issued, and if necessary, it may be extended once but not more than 3 months.

What are regulations on investigation contents for applying anti-dumping measures in Vietnam?

kết quả bóng đá trực tiếp investigation contents for applying anti-dumping measures stipulated in Article 80 of kết quả bóng đá trực tiếpLaw on Foreign Trade Management 2017are as follows:

(1) Determine kết quả bóng đá trực tiếp goods being dumped and imported into Vietnam, and kết quả bóng đá trực tiếp dumping margin, including:

- Determining kết quả bóng đá trực tiếp normal value;

- Determining kết quả bóng đá trực tiếp export price;

- Conducting a fair comparison between kết quả bóng đá trực tiếp normal value and kết quả bóng đá trực tiếp export price, and determining kết quả bóng đá trực tiếp specific dumping margin of kết quả bóng đá trực tiếp goods subject to investigation for each organization and individual producing and exporting kết quả bóng đá trực tiếp investigated goods (hereinafter referred to as manufacturers, exporters).

(2) Determine kết quả bóng đá trực tiếp significant damage or threat of significant damage to kết quả bóng đá trực tiếp domestic industry or prevention of kết quả bóng đá trực tiếp establishment of a domestic industry.

(3) Determine kết quả bóng đá trực tiếp causal relationship between kết quả bóng đá trực tiếp importation of dumped goods and kết quả bóng đá trực tiếp significant damage or threat of significant damage to kết quả bóng đá trực tiếp domestic industry or kết quả bóng đá trực tiếp prevention of kết quả bóng đá trực tiếp establishment of a domestic industry.

(4) Determine kết quả bóng đá trực tiếp impact of kết quả bóng đá trực tiếp anti-dumping measures on socio-economics.
