Vietnam: Will resignation requests from teachers in cases where they have not worked xoilac tv trực tiếp bóng đá hôm nay full committed time be handled?
According to Clause 2, Article 57 ofDecree 115/2020/ND-CP, amended by Clause 34, Article 1 ofDecree 85/2023/ND-CP, xoilac tv trực tiếp bóng đá hôm nay resignation of teachers is regulated as follows:
Resignation of a Public Employee
...
- A public employee is not allowed to resign if they fall into one of xoilac tv trực tiếp bóng đá hôm nay following cases:
a) Under disciplinary action, under investigation, prosecution, or trial;
b) Has not fulfilled xoilac tv trực tiếp bóng đá hôm nay committed service period with xoilac tv trực tiếp bóng đá hôm nay public service provider after being sent for training, except in cases where they have compensated xoilac tv trực tiếp bóng đá hôm nay training costs;
c) Has not completed xoilac tv trực tiếp bóng đá hôm nay payment of any due monetary amounts or assets owed to xoilac tv trực tiếp bóng đá hôm nay public service provider;
d) Due to work requirements and there is no replacement.
- Resignation procedures:
a) In case a public employee unilaterally terminates their employment contract, they must notify in writing to xoilac tv trực tiếp bóng đá hôm nay head of xoilac tv trực tiếp bóng đá hôm nay public service provider as per xoilac tv trực tiếp bóng đá hôm nay regulations in Clause 6, Article 29 of xoilac tv trực tiếp bóng đá hôm nay Law on Public Employees.
Within 5 working days from xoilac tv trực tiếp bóng đá hôm nay date of receipt of xoilac tv trực tiếp bóng đá hôm nay written request from xoilac tv trực tiếp bóng đá hôm nay public employee, if xoilac tv trực tiếp bóng đá hôm nay resignation is agreed upon, xoilac tv trực tiếp bóng đá hôm nay head of xoilac tv trực tiếp bóng đá hôm nay public service provider shall terminate xoilac tv trực tiếp bóng đá hôm nay employment contract and settle resignation policies for xoilac tv trực tiếp bóng đá hôm nay public employee as per xoilac tv trực tiếp bóng đá hôm nay regulations. If xoilac tv trực tiếp bóng đá hôm nay resignation is not agreed upon, they must respond in writing to xoilac tv trực tiếp bóng đá hôm nay public employee, clearly stating xoilac tv trực tiếp bóng đá hôm nay reason as per xoilac tv trực tiếp bóng đá hôm nay regulations.
b) In case a public service provider unilaterally terminates xoilac tv trực tiếp bóng đá hôm nay employment contract or does not renew xoilac tv trực tiếp bóng đá hôm nay employment contract with a public employee, they must concurrently settle resignation policies for xoilac tv trực tiếp bóng đá hôm nay public employee as per xoilac tv trực tiếp bóng đá hôm nay regulations.

Thus, teachers who wish to resign before fulfilling their committed service period are still allowed to have resignation policies settled if they have compensated xoilac tv trực tiếp bóng đá hôm nay training costs.

How is severance pay for teachers in Vietnamcalculated?
(1) For teachers who resign with service time from December 31, 2008, and prior, xoilac tv trực tiếp bóng đá hôm nay severance pay is calculated according to Clause 1, Article 58 ofDecree 115/2020/ND-CPas follows:
- For each year of service, xoilac tv trực tiếp bóng đá hôm nay allowance is equal to half a month's salary currently received, including: Salary according to professional title, management position allowances, exceeded seniority allowances, professional seniority allowances, and retained salary differential coefficient (if any).
- xoilac tv trực tiếp bóng đá hôm nay minimum severance pay is equal to 1 month’s salary currently received.
- For teachers recruited before July 01, 2003, xoilac tv trực tiếp bóng đá hôm nay working time for calculating xoilac tv trực tiếp bóng đá hôm nay severance pay is xoilac tv trực tiếp bóng đá hôm nay total working time (cumulative) from xoilac tv trực tiếp bóng đá hôm nay date of xoilac tv trực tiếp bóng đá hôm nay recruitment decision until xoilac tv trực tiếp bóng đá hôm nay end of December 31, 2008.
- For teachers recruited from July 01, 2003 onwards, xoilac tv trực tiếp bóng đá hôm nay working time for calculating xoilac tv trực tiếp bóng đá hôm nay severance pay is xoilac tv trực tiếp bóng đá hôm nay total working time under xoilac tv trực tiếp bóng đá hôm nay employment contract (cumulative) from xoilac tv trực tiếp bóng đá hôm nay date of xoilac tv trực tiếp bóng đá hôm nay recruitment decision until xoilac tv trực tiếp bóng đá hôm nay end of December 31, 2008.
(2) For teachers who resign with service time from January 01, 2009 until now, it is implemented according to Article 50 of xoilac tv trực tiếp bóng đá hôm nayLaw on Employment 2013:
- xoilac tv trực tiếp bóng đá hôm nay monthly unemployment benefit received is 60% of xoilac tv trực tiếp bóng đá hôm nay average monthly salary for 6 consecutive months before unemployment but not exceeding 5 times xoilac tv trực tiếp bóng đá hôm nay statutory pay rate.
- xoilac tv trực tiếp bóng đá hôm nay unemployment benefit period is calculated based on xoilac tv trực tiếp bóng đá hôm nay number of months of unemployment insurance contributions. Every 12 months to 36 months of contributions entitle xoilac tv trực tiếp bóng đá hôm nay employee to 3 months of unemployment benefits. After that, every additional 12 months of contributions entitle xoilac tv trực tiếp bóng đá hôm nay employee to 1 more month of unemployment benefits, but xoilac tv trực tiếp bóng đá hôm nay total period shall not exceed 12 months.
Where do sources ofseverance payfor teachers in Vietnam come from?
Clause 3, Article 58 ofDecree 115/2020/ND-CPprovides for xoilac tv trực tiếp bóng đá hôm nay source of funds for paying severance pays to teachers as follows:
- For public service providers covering their own recurrent and investment expenditures: xoilac tv trực tiếp bóng đá hôm nay funding for severance pays is sourced from xoilac tv trực tiếp bóng đá hôm nay unit's financial resources, including xoilac tv trực tiếp bóng đá hôm nay time xoilac tv trực tiếp bóng đá hôm nay teacher previously worked in other entities within xoilac tv trực tiếp bóng đá hôm nay political system.
- For public service providers partially covering their own recurrent expenditures or with recurrent expenditures guaranteed by xoilac tv trực tiếp bóng đá hôm nay state budget: xoilac tv trực tiếp bóng đá hôm nay funding for severance pays is sourced from xoilac tv trực tiếp bóng đá hôm nay financial resources of xoilac tv trực tiếp bóng đá hôm nay public service provider, including xoilac tv trực tiếp bóng đá hôm nay time xoilac tv trực tiếp bóng đá hôm nay teacher previously worked in other entities within xoilac tv trực tiếp bóng đá hôm nay political system.
In cases where xoilac tv trực tiếp bóng đá hôm nay financial resources of xoilac tv trực tiếp bóng đá hôm nay public service provider are insufficient to cover xoilac tv trực tiếp bóng đá hôm nay severance pay for xoilac tv trực tiếp bóng đá hôm nay time xoilac tv trực tiếp bóng đá hôm nay public employee previously worked in other entities within xoilac tv trực tiếp bóng đá hôm nay political system, xoilac tv trực tiếp bóng đá hôm nay state budget will provide support.
