Is it necessary for a preschool in Vietnam to disclose in-kind sponsorships when mobilizing sponsorships?

Based on Article 2Circular 16/2018/TT-BGDDT, kết quả bóng đá trực tiếp principles of mobilization, receipt, management and use of sponsorships are as follows:

Principles of mobilization, receipt, management and use of sponsorships

1. Sponsorship must adhere to kết quả bóng đá trực tiếp principle of voluntariness, public disclosure, transparency, non-compulsion, no restriction on kết quả bóng đá trực tiếp average amount of sponsorship, no restriction on kết quả bóng đá trực tiếp minimum amount of sponsorship, avoid exploiting educational sponsorship to force contributions, and must not consider mobilization of sponsorships as mandatory conditions for provision of educational and training services.

2. kết quả bóng đá trực tiếp mobilization, receipt, management and use of sponsorships must be published and publicly posted on notice boards of educational institutions receiving sponsorships, and must strictly observe regulations laid down in applicable laws.

3. kết quả bóng đá trực tiếp management and use of sponsorships must conform to kết quả bóng đá trực tiếp principle of cost efficiency, effectiveness, serving kết quả bóng đá trực tiếp right purposes, avoiding any loss or wastefulness.

4. Physical objects that are not suitable for use in educational institutions or those that are harmful or dangerous to kết quả bóng đá trực tiếp environment and kết quả bóng đá trực tiếp health of officials, teachers, employees and students must be avoided.

5. Sponsors should be encouraged to put their own stakes in kết quả bóng đá trực tiếp construction and purchase of equipment and kết quả bóng đá trực tiếp complete installation thereof for handover to educational institutions according to kết quả bóng đá trực tiếp agreement and guidance of educational establishments.

6. Organizations and individuals should be encouraged to offer their sponsorships and aids for kết quả bóng đá trực tiếp purposes of educational development, improvement of educational infrastructure, support for teaching, learning and educational activities at educational institutions

Thus,according to kết quả bóng đá trực tiếp above principles for mobilization, receipt, management and use of sponsorships, it is determined that if preschools mobilize in-kind sponsorships, they must publicize kết quả bóng đá trực tiếp receipt of such sponsorships at kết quả bóng đá trực tiếp place they are received.

What are procedures for mobilizing sponsorshipsfor a preschool in Vietnam?

Based on Article 5Circular 16/2018/TT-BGDDT, kết quả bóng đá trực tiếp procedures for mobilizing sponsorships for a preschool in Vietnam are as follows:

Phase 1:Based on kết quả bóng đá trực tiếp annual school activity plan and kết quả bóng đá trực tiếp budget estimates from state agencies, periodically or suddenly, kết quả bóng đá trực tiếp preschool develops a sponsorship mobilization plan and reports it to kết quả bóng đá trực tiếp Department of Education and Training for approval for preschool;

Reports to kết quả bóng đá trực tiếp Department of Education and Training for approval for high schools and other educational institutions under kết quả bóng đá trực tiếp Department of Education and Training before organizing kết quả bóng đá trực tiếp mobilization of sponsorships.

Phase 2:kết quả bóng đá trực tiếp Department of Education and Training and kết quả bóng đá trực tiếp local Department of Education and Training are responsible for appraising and approving kết quả bóng đá trực tiếp sponsorship mobilization plan within 15 days from kết quả bóng đá trực tiếp date of receipt of kết quả bóng đá trực tiếp preschool's dossier.

If kết quả bóng đá trực tiếp sponsorship mobilization plan is found not to comply with kết quả bóng đá trực tiếp process, regulations, and not being transparent, kết quả bóng đá trực tiếp educational institution must be required to stop implementing kết quả bóng đá trực tiếp sponsorship mobilization plan.

Phase 3:kết quả bóng đá trực tiếp sponsorship mobilization plan must clearly define kết quả bóng đá trực tiếp content, purpose, beneficiaries, estimated budget, and kết quả bóng đá trực tiếp plan to implement kết quả bóng đá trực tiếp activities needing sponsorships.

What are regulations on receipt ofin-kind sponsorshipsof a preschool in Vietnam?

Based on Article 6Circular 16/2018/TT-BGDDT, a preschool receives in-kind sponsorships as follows:

Establishment of kết quả bóng đá trực tiếp Sponsorship Receiving Panel

-An educational institution shall be responsible for establishing kết quả bóng đá trực tiếp Sponsorship Receiving Panel. kết quả bóng đá trực tiếp Sponsorship Receiving Panel shall comprise kết quả bóng đá trực tiếp following main members: kết quả bóng đá trực tiếp head of an educational institution, kết quả bóng đá trực tiếp chief accountant, kết quả bóng đá trực tiếp parent representative council or kết quả bóng đá trực tiếp Board of Representatives of Communist Youth Union of Ho Chi Minh City, kết quả bóng đá trực tiếp Student Association; representatives of kết quả bóng đá trực tiếp community at kết quả bóng đá trực tiếp area where kết quả bóng đá trực tiếp educational institution is located (if any);

- kết quả bóng đá trực tiếp head of an educational institution shall become kết quả bóng đá trực tiếp group leader;

- kết quả bóng đá trực tiếp Sponsorship Receiving Panel shall be responsible for widely informing and disseminating kết quả bóng đá trực tiếp purposes, significance and principles of sponsorship activities; provide information on kết quả bóng đá trực tiếp time, address, name and deposit account number of kết quả bóng đá trực tiếp educational institution receiving sponsorships; pre-acceptance testing, transfer and use of in-kind or non-material sponsorships;

- kết quả bóng đá trực tiếp Sponsorship Receiving Panel shall be automatically dissolved after completion of sponsorship tasks.

kết quả bóng đá trực tiếp educational institution shall implement kết quả bóng đá trực tiếp process of receiving sponsorships as follows:

- Cash sponsorships:

+ kết quả bóng đá trực tiếp educational institution must open kết quả bóng đá trực tiếp detailed accounting book to separately monitor kết quả bóng đá trực tiếp sponsorship amounts; open an account at a bank or state treasury to receive sponsorships through kết quả bóng đá trực tiếp wire transfer service;

+ In case sponsorships are granted in kết quả bóng đá trực tiếp form of diamonds, gems, precious metals or other valuable objects, kết quả bóng đá trực tiếp educational institution shall collaborate with kết quả bóng đá trực tiếp Sponsorship Receiving Panel in selling them to commercial banks or auction organizers, and send kết quả bóng đá trực tiếp proceeds to that educational institution's account.

- In-kind sponsorships:

+ kết quả bóng đá trực tiếp educational institution shall cooperate with kết quả bóng đá trực tiếp Sponsorship Receiving Panel in carrying out kết quả bóng đá trực tiếp procedures for receiving kết quả bóng đá trực tiếp transfer, site and warehousing preparations for kết quả bóng đá trực tiếp preservation of donated objects in a fast and convenient manner;

+ As regards a capital construction project in kết quả bóng đá trực tiếp form of "turnkey" granted as a sponsorship, kết quả bóng đá trực tiếp sponsor shall be obliged to hand over dossiers, documents and other evidences related to construction activities to kết quả bóng đá trực tiếp educational institution and kết quả bóng đá trực tiếp financial body at kết quả bóng đá trực tiếp same level in order to enter kết quả bóng đá trực tiếp value of kết quả bóng đá trực tiếp construction project of which handover is completed into kết quả bóng đá trực tiếp accounting record.

kết quả bóng đá trực tiếp preparation of kết quả bóng đá trực tiếp financial report on capital according to kết quả bóng đá trực tiếp provisions of kết quả bóng đá trực tiếp Circular No. 09/2016 /TT-BTC dated January 18, 2016 of kết quả bóng đá trực tiếp Ministry of Finance prescribing kết quả bóng đá trực tiếp financial reporting of completed projects financed by kết quả bóng đá trực tiếp state budget shall be encouraged;

+ If equipment or machinery is granted as a sponsorship, kết quả bóng đá trực tiếp sponsor shall supply documents and/or technical dossiers to kết quả bóng đá trực tiếp educational institution according to regulations in force.

- As for non-material sponsorships, kết quả bóng đá trực tiếp educational institution shall receive, manage and use them in accordance with legislative regulations on intellectual property and other laws in force.

In case of kết quả bóng đá trực tiếp land use right granted as a sponsorship, kết quả bóng đá trực tiếp sponsor shall provide dossiers related to that land use right and complete kết quả bóng đá trực tiếp procedures for transfer of that land use right transfer to kết quả bóng đá trực tiếp educational institution for its receipt, management and use in accordance with land legislation.

Thus,when kết quả bóng đá trực tiếp preschool receives in-kind sponsorships, it cooperates with kết quả bóng đá trực tiếp sponsorship Sponsorship Receiving Panel to handle kết quả bóng đá trực tiếp procedures for receipt, prepare space, and storage to preserve kết quả bóng đá trực tiếp in-kind sponsorships promptly and efficiently.
