FACTUAL AND PROCEDURAL BACKGROUND

Ch made a deposit for Mr. Ng amounting to VND 50,000,000 and still owes VND 230,000,000.

On January 28, 2021, A called on Zalo to hire Ch to transport 01 anchor, 02 bags of rice, 10 pieces of plastic foam to xem bóng đá trực tiếp trên youtube sea for A, then transport squids to xem bóng đá trực tiếp trên youtube mainland for from VND 1,000,000 to VND 3,000,000/01 trip, depending on xem bóng đá trực tiếp trên youtube distance. After reaching an agreement with A, Ch hired Le Van D to load goods, fish for squid with Ch. Ch pays a wage of VND 400,000 per day. D agreed and Tran Thi Th, D's wife, advanced an amount of VND 4,000,000.

At about 5:00 p.m. on January 30, 2021, Ch operated xem bóng đá trực tiếp trên youtube boat CM 91651 TS and D departed along xem bóng đá trực tiếp trên youtube river to xem bóng đá trực tiếp trên youtube Ganh Hao estuary - Bac Lieu to go to xem bóng đá trực tiếp trên youtube sea. At 08 o'clock on xem bóng đá trực tiếp trên youtube same day, A operated xem bóng đá trực tiếp trên youtube fishing boat to dock with Ch's boat for 02 people to pass through Ch's boat to receive xem bóng đá trực tiếp trên youtube goods carried by Ch. Next, A took 34 people on A's boat to Ch's boat, so that Ch could bring them back to Vietnam to illegally enter Vietnam, and then A and Ch operated xem bóng đá trực tiếp trên youtube boats away.

At around 4pm on February 2, 2021, A used a foreign phone number (+601135727501) to call S. A told S that about 01:00 a.m. on February 3, 2021, when a cargo boat arrived, A asked S to rent 01 more boat. After that, S and his sister, Pham Thi Chuong, contacted Pham Van S1 and Pham Van V to rent a boat for VND 3,000,000, S prepaid S1 an amount of VND 2,000,000.

At about 01:38 on February 3, 2021, xem bóng đá trực tiếp trên youtube Song Doc Border Guard Station patrolled, detected, and caught Ch, D and 34 people red-handed illegally entering Vietnam, including: (1) Vo Thi Anh Ng, (2) Vo Thi Thu V, (3) Nguyen Van H, (4) Pham Van Th, (5) Tran Thi My T, (6) Nguyen Thi Bich Ng, (7) Y Sa Kiel Ml, (8) Tran Thi Th, (9) Dang Thi T, (10) Le Ngoc Minh Th, (11) Luu Xuan H, (12).Vo Thi L, (13) Nguyen Thi Dieu Th, (14) Tran Thi Ngoc Tr, ( 15) Do Thi Ng, (16) Nguyen Thi Do L, (17) Nguyen Thi Mong Tr, (18) Cao Thi B, (19) Luong Thi K, (20) Nguyen Thi Kim H, (21) Nguyen Thi Cam T, (22) Le Thuy Hong Tr, (23) Tran Thi Th, (24) Le Thi Th, (25) Ngo Thi My Ng, (26) Trinh Ngoc Th, (27) Nguyen Huu Tr, (28) Le Van Th, (29) Tran Thi L, (30) Doan Van H, (31) Kpa H' U, (32) Le Thi Kim Th, (33) Le Anh Ng, (34) Le Van Th went to Covid-19 quarantine at xem bóng đá trực tiếp trên youtube Infantry Regiment 896, Ca Mau province.

Ch determined that if he brought these 34 people through without being detected by xem bóng đá trực tiếp trên youtube authorities, A would pay Ch a certain amount, minus xem bóng đá trực tiếp trên youtube cost, there would be a profit, but it was not determined how much it would be.

On February 5, 2021, while Ch underwent a Covid-19 quarantine, Vo Ngoc V (Ch's wife) borrowed a loan from Mrs. Nguyen Thi Th1 who is xem bóng đá trực tiếp trên youtube biological mother of Mr. Ho Hoang Ng (boat seller) an amount of VND 100,000,000, interest rate VND 8,000,000/month; V asked Th, xem bóng đá trực tiếp trên youtube wife of Le Van D, who worked as an employee on Ch's boat) to mortgage xem bóng đá trực tiếp trên youtube property and borrow 100,000,000 VND for V, with a profit of 5,000,000 VND/month; V pawned gold for xem bóng đá trực tiếp trên youtube amount of VND 30,000,000 and repaid xem bóng đá trực tiếp trên youtube full debt of VND 230,000,000 (two hundred and thirty million dong) to buy xem bóng đá trực tiếp trên youtube boat to Ng.

JUDGEMENT OF xem bóng đá trực tiếp trên youtube COURT

Based on xem bóng đá trực tiếp trên youtube contents of xem bóng đá trực tiếp trên youtube case and documents available in xem bóng đá trực tiếp trên youtube case file that have been litigated at xem bóng đá trực tiếp trên youtube trial, xem bóng đá trực tiếp trên youtube Trial Panel shall determine as follows:

[1] Regarding xem bóng đá trực tiếp trên youtube procedural acts and decisions of xem bóng đá trực tiếp trên youtube investigation body, investigators, procuracy and procurators, in xem bóng đá trực tiếp trên youtube course of investigation and prosecution, they have complied with procedures and taken actions intra vires as prescribed by xem bóng đá trực tiếp trên youtube Criminal Procedure Code. During xem bóng đá trực tiếp trên youtube investigation process, it was determined that 34 people were all Vietnamese who had migrated to Malaysia mainly in xem bóng đá trực tiếp trên youtube form of labor export, tourism, or visiting relatives (by air). Due to xem bóng đá trực tiếp trên youtube outbreak of xem bóng đá trực tiếp trên youtube Covid-19 epidemic, they could not return to Vietnam by legal means. xem bóng đá trực tiếp trên youtube fact that their lives and work in Malaysia had faced many difficulties and xem bóng đá trực tiếp trên youtube traditional New Year was approaching hurried them into returning to Vietnam to reunite with their family, so they looked for brokers in Malaysia (named A, S) to illegally enter Vietnam by sea. Compared with xem bóng đá trực tiếp trên youtube evidence contained in xem bóng đá trực tiếp trên youtube file, it was found that: xem bóng đá trực tiếp trên youtube defendant just bought xem bóng đá trực tiếp trên youtube boat CM 91651TS on January 25, 2021 (still owed money to buy xem bóng đá trực tiếp trên youtube ship) and until xem bóng đá trực tiếp trên youtube defendant received and carried 34 people at 08:00 on January 31, 2021, it was xem bóng đá trực tiếp trên youtube first time xem bóng đá trực tiếp trên youtube defendant operated a vehicle to xem bóng đá trực tiếp trên youtube sea to catch seafood (case file p. 146, 160). According to xem bóng đá trực tiếp trên youtube defendant, each fishing trip costs him a lot of money and time. In fact, at sea, xem bóng đá trực tiếp trên youtube defendant did not catch seafood, when he met A's boat and people from A's boat came aboard xem bóng đá trực tiếp trên youtube defendant's boat, xem bóng đá trực tiếp trên youtube defendant had no objection. Therefore, only with more benefits than profits from fishing, xem bóng đá trực tiếp trên youtube defendant transported people to Vietnam without permission of xem bóng đá trực tiếp trên youtube competent authority. xem bóng đá trực tiếp trên youtube defendant's testimonies during xem bóng đá trực tiếp trên youtube investigation also clearly demonstrated this self-seeking purpose (case file p. 137-138; 145-150; 154). With these circumstances, xem bóng đá trực tiếp trên youtube fact that xem bóng đá trực tiếp trên youtube People's Procuracy of Ca Mau province prosecuted xem bóng đá trực tiếp trên youtube defendant for xem bóng đá trực tiếp trên youtube crime of "Organizing others to enter Vietnam illegally" specified at Point a, Clause 3, Article 348 of xem bóng đá trực tiếp trên youtube Criminal Code was found grounded, not unfair to xem bóng đá trực tiếp trên youtube defendant, consistent with xem bóng đá trực tiếp trên youtube defense of xem bóng đá trực tiếp trên youtube lawyer about xem bóng đá trực tiếp trên youtube crime.

[4] With xem bóng đá trực tiếp trên youtube defendant's act of operating xem bóng đá trực tiếp trên youtube fishing boat CM 91651TS carrying 34 Vietnamese people from Malaysia to illegally enter by sea, it is dangerous to society and falls under a felony, directly infringing on human rights and interests, administrative management in xem bóng đá trực tiếp trên youtube field of exit and entry by competent authorities of xem bóng đá trực tiếp trên youtube Socialist Republic of Vietnam. At xem bóng đá trực tiếp trên youtube time xem bóng đá trực tiếp trên youtube defendant committed xem bóng đá trực tiếp trên youtube act, xem bóng đá trực tiếp trên youtube Covid-19 pandemic had progressed in a complicated and unpredictable way, not only for Vietnam but also on a global scale, xem bóng đá trực tiếp trên youtube number of new infections and deaths had shown no sign of stopping and there was no cure. As for Ca Mau province in particular and xem bóng đá trực tiếp trên youtube whole country in general, xem bóng đá trực tiếp trên youtube number of infected people had not decreased, seriously threatening life, human health and socio-economics. As for xem bóng đá trực tiếp trên youtube defendant, just for xem bóng đá trực tiếp trên youtube sake of self-seeking motive, xem bóng đá trực tiếp trên youtube defendant intentionally did this despite xem bóng đá trực tiếp trên youtube danger of xem bóng đá trực tiếp trên youtube pandemic and xem bóng đá trực tiếp trên youtube efforts of xem bóng đá trực tiếp trên youtube whole society.

With a large number of people entering Vietnam illegally as above, one of xem bóng đá trực tiếp trên youtube risks of disease infection from outside was very high, not only a danger to xem bóng đá trực tiếp trên youtube country's pandemic prevention efforts during this time but also related to national security and order. In xem bóng đá trực tiếp trên youtube context that xem bóng đá trực tiếp trên youtube people of Ca Mau province in particular and xem bóng đá trực tiếp trên youtube whole country in general were having to implement strict solutions to join hands to prevent and control xem bóng đá trực tiếp trên youtube pandemic, a strict sanction against xem bóng đá trực tiếp trên youtube defendant was essential.

[5] When deciding xem bóng đá trực tiếp trên youtube penalty, xem bóng đá trực tiếp trên youtube Trial Panel considered xem bóng đá trực tiếp trên youtube following mitigating circumstances for xem bóng đá trực tiếp trên youtube defendant: Low education level; having a biological father who is a wounded soldier; no prior criminal record or administrative violation. [7] Regarding exhibit handling:
