Are complaints eligible for settlement in Vietnam if xem bóng đá trực tiếp nhà cái they does not have signature of complainant?

1. Are complaints eligible for settlement in Vietnam if xem bóng đá trực tiếp nhà cái they does not have signature of complainant?

According to Article 11 of xem bóng đá trực tiếp nhà cáiLaw No. 02/2011/QH13 lịch, a complaint falling into one of xem bóng đá trực tiếp nhà cái following cases is not accepted for settlement:

- It is about an administrative decision or act within a state agency for directing and organizing xem bóng đá trực tiếp nhà cái performance of tasks and official duties; an administrative decision or act related to direction and administration by an administrative agency toward its subordinate administrative agency; an administrative decision containing legal rules issued by competent agencies, organizations or persons according to xem bóng đá trực tiếp nhà cái order and procedures prescribed in law on promulgation of legal documents; an administrative decision or act involving a state secret in xem bóng đá trực tiếp nhà cái field of defense, security or foreign affairs as listed by xem bóng đá trực tiếp nhà cái Government;

- It is about an administrative decision or act not directly related to xem bóng đá trực tiếp nhà cái rights and lawful interests of xem bóng đá trực tiếp nhà cái complainant;

- xem bóng đá trực tiếp nhà cái complainant has no full civil act capacity and no a lawful representative;

- xem bóng đá trực tiếp nhà cái complaint is implemented by an unlawful representative;

- There is no signature or fingerprint of complainant in xem bóng đá trực tiếp nhà cái written complaint;

- xem bóng đá trực tiếp nhà cái statute of limitations or time limit for making a complaint has expired but xem bóng đá trực tiếp nhà cái complainant has no legitimate reason;

- A second-time complaint settlement decision has been issued;

- There is a written notice of suspension of xem bóng đá trực tiếp nhà cái complaint settlement and xem bóng đá trực tiếp nhà cái complainant does not continue making complaint during 30 days after xem bóng đá trực tiếp nhà cái issuance of such notice;

- It has been accepted by a court for settlement or has been settled under a court judgment or decision other than a court’s decision on suspension of xem bóng đá trực tiếp nhà cái settlement of an administrative case.

Thus, according to xem bóng đá trực tiếp nhà cái above regulations, if xem bóng đá trực tiếp nhà cái complaint does not have xem bóng đá trực tiếp nhà cái signature of complainant, it will not be accepted for settlement.

2. Regulations on rights and obligations of complainants in Vietnam

According to Article 12 of xem bóng đá trực tiếp nhà cáiLaw No. 02/2011/QH13 lịch, xem bóng đá trực tiếp nhà cái rights and obligations of complainants are stipulated as follows:

A complainant has xem bóng đá trực tiếp nhà cái following rights:

- To make a complaint by him/herself.

In case xem bóng đá trực tiếp nhà cái complainant is a minor or has lost, his/her civil act capacity, his/her representative at law may implement a complaint.

In case xem bóng đá trực tiếp nhà cái complainant is ill or old and weak or has a physical defect or encounters an objective circumstance which causes him/her unable to implement a complaint, he/she may authorize his/her parent, spouse, blood sibling or adult child or another person with full civil act capacity to implement a complaint;

- To ask a legal counsel or authorize a lawyer to make a complaint to protect his/her rights and lawful interests.

In case xem bóng đá trực tiếp nhà cái complainant is eligible for legal aid as specified by law, he/she is entitled to ask a legal aid officer to provide legal consultancy or authorize a legal aid officer to make a complaint to protect his/her rights and lawful interests;

- To participate in dialogs or authorize a lawful representative to do so;

- To be entitled to know, read, photocopy or copy documents and evidences collected by xem bóng đá trực tiếp nhà cái complaint settler for settling his/her complaint, except information and documents involving state secrets;

- To request relevant persons, agencies and organizations that are preserving or managing information and documents related to his/her complaint contents to provide such information and documents within 07 days after being requested for submission to xem bóng đá trực tiếp nhà cái complaint settler, except information and documents falling in state secrets;

- To request xem bóng đá trực tiếp nhà cái complaint settler to apply urgent measures to prevent possible consequences of xem bóng đá trực tiếp nhà cái execution of xem bóng đá trực tiếp nhà cái complained administrative decision;

- To show evidences of xem bóng đá trực tiếp nhà cái complaint and make explanation on his/her opinions for these evidences;

- To receive a written reply on xem bóng đá trực tiếp nhà cái acceptance of xem bóng đá trực tiếp nhà cái complaint for settlement, to receive xem bóng đá trực tiếp nhà cái complaint settlement decision;

- To have his/her infringed rights and lawful interests restored; to receive damage compensations in accordance with law;

- To make a second-time complaint or institute an administrative case at court in accordance with xem bóng đá trực tiếp nhà cáiLuật tố tụng kết quả bóng đá trực

- To withdraw his/her complaint.

A complainant has xem bóng đá trực tiếp nhà cái following obligations:

- To make a complaint with xem bóng đá trực tiếp nhà cái right person who is competent to settlement;

- To honestly present xem bóng đá trực tiếp nhà cái matter and show evidences of xem bóng đá trực tiếp nhà cái correctness and reasonability of xem bóng đá trực tiếp nhà cái complaint; to provide relevant information and documents to xem bóng đá trực tiếp nhà cái complaint settler; to take responsibility before law for xem bóng đá trực tiếp nhà cái presented contents and provided information and documents:

- To abide by xem bóng đá trực tiếp nhà cái administrative decision or act about which he/she makes a complaint pending xem bóng đá trực tiếp nhà cái complaint settlement, unless such decision or act is suspended from execution as prescribed in Article 35 of xem bóng đá trực tiếp nhà cáiLaw No. 02/2011/QH13 lịch;

- To strictly abide by xem bóng đá trực tiếp nhà cái legally effective complaint settlement decision.

Thus, according to xem bóng đá trực tiếp nhà cái above regulations, xem bóng đá trực tiếp nhà cái complainant has both xem bóng đá trực tiếp nhà cái right to be protected and xem bóng đá trực tiếp nhà cái obligation to perform to ensure his or her legitimate rights.
