Thank you for your question. Lawnet would like to answer as follows:

Pursuant to trực tiếp bóng đá k+ provisions of Article 34 of trực tiếp bóng đá k+Bộ luật xem bóng, cases of termination of labor contracts include:

- trực tiếp bóng đá k+ employment contract expires, except for trực tiếp bóng đá k+ case specified in Clause 4 Article 177 of this Code.

- trực tiếp bóng đá k+ tasks stated in trực tiếp bóng đá k+ employment contract have been completed.

- Both parties agree to terminate trực tiếp bóng đá k+ employment contract.

- trực tiếp bóng đá k+ employee is sentenced to imprisonment without being eligible for suspension or release as prescribed in Clause 5 Article 328 of trực tiếp bóng đá k+ Criminal Procedure Code, capital punishment or is prohibited from performing trực tiếp bóng đá k+ work stated in trực tiếp bóng đá k+ employment contract by an effective verdict or judgment of trực tiếp bóng đá k+ court.

- trực tiếp bóng đá k+ foreign employee working in Vietnam is expelled by an effective verdict or judgment of trực tiếp bóng đá k+ court or a decision of a competent authority.

- trực tiếp bóng đá k+ employee dies; is declared by trực tiếp bóng đá k+ court as a legally incapacitated person, missing or dead.

- trực tiếp bóng đá k+ employer that is a natural person dies; is declared by trực tiếp bóng đá k+ court as a legally incapacitated person, missing or dead. trực tiếp bóng đá k+ employer that is not a natural person ceases to operate, or a business registration authority affiliated to trực tiếp bóng đá k+ People’s Committee of trực tiếp bóng đá k+ province (hereinafter referred to as “provincial business registration authority”) issues a notice that trực tiếp bóng đá k+ employer does not have a legal representative or a person authorized to exercise trực tiếp bóng đá k+ legal representative’s rights and obligations.

- trực tiếp bóng đá k+ employee is dismissed for disciplinary reasons.

- trực tiếp bóng đá k+ employee unilaterally terminates trực tiếp bóng đá k+ employment contract in accordance with Article 35 of this Code.

- trực tiếp bóng đá k+ employer unilaterally terminates trực tiếp bóng đá k+ employment contract in accordance with Article 36 of this Code.

- trực tiếp bóng đá k+ employer allows trực tiếp bóng đá k+ employee to resigns in accordance with Article 42 and Article 43 of this Code.

- trực tiếp bóng đá k+ work permit or a foreign employee expires according to Article 156 of this Labor Code.

- trực tiếp bóng đá k+ employee fails to perform his/her tasks during trực tiếp bóng đá k+ probationary period under trực tiếp bóng đá k+ employment contract or gives up trực tiếp bóng đá k+ probation.

Thus, in case of quitting a job before trực tiếp bóng đá k+ expiration of trực tiếp bóng đá k+ labor contract, trực tiếp bóng đá k+ employee can legally terminate trực tiếp bóng đá k+ labor contract in one of two ways:

Firstly, agree to terminate trực tiếp bóng đá k+ labor contract with trực tiếp bóng đá k+ employer.

trực tiếp bóng đá k+ employee will present his desire to quit and trực tiếp bóng đá k+ time he will take leave to reach an agreement with trực tiếp bóng đá k+ employer on trực tiếp bóng đá k+ termination of trực tiếp bóng đá k+ labor contract. trực tiếp bóng đá k+ company will consider and agree to let trực tiếp bóng đá k+ employee leave, sometimes may agree to let trực tiếp bóng đá k+ employee leave earlier if an alternative position can be arranged.

Secondly, unilaterally terminate trực tiếp bóng đá k+ lawful labor contract.

This is trực tiếp bóng đá k+ case that when trực tiếp bóng đá k+ employee asks for opinions but trực tiếp bóng đá k+ company does not approve, trực tiếp bóng đá k+ employee is still entitled to leave according to trực tiếp bóng đá k+ provisions of Article 35 of trực tiếp bóng đá k+ 2019 Labor Code. At that time, trực tiếp bóng đá k+ employee only needs to send prior notice:

- If working under an indefinite term labor contract:

+ At least 45 days notice: If doing normal work.

+ At least 120 days advance notice: If working as a member of trực tiếp bóng đá k+ flight crew; aircraft maintenance staff, business managers, etc.

- If working under a labor contract with a term of 12 - 36 months:

+ At least 30 days notice: If doing normal work.

+ At least 120 days advance notice: If working as a member of trực tiếp bóng đá k+ flight crew; aircraft maintenance staff, business managers, etc.

- If working under a labor contract with a term of less than 12 months:

+ At least 3 working days notice: If doing normal work.

+ Notice at least ¼ of trực tiếp bóng đá k+ contract term: If doing a specific job such as a member of trực tiếp bóng đá k+ flight crew; aircraft maintenance staff, business managers.

Note thatan employee is shall have trực tiếp bóng đá k+ right to unilaterally terminate trực tiếp bóng đá k+ employment contract without prior notice if he/she:

- is not assigned to trực tiếp bóng đá k+ work or workplace or not provided with trực tiếp bóng đá k+ working conditions as agreed in trực tiếp bóng đá k+ employment contract, except for trực tiếp bóng đá k+ cases specified in Article 29 of this Labor Code;

- is not paid adequately or on schedule, except for trực tiếp bóng đá k+ case specified in Clause 4 Article 97 of this Code.

- is maltreated, assaulted, physically or verbally insulted by trực tiếp bóng đá k+ employer in a manner that affects trực tiếp bóng đá k+ employee’s health, dignity or honor; is forced to work against his/her will;

- is sexually harassed in trực tiếp bóng đá k+ workplace;

- is pregnant and has to stop working in accordance with Clause 1 Article 138 of this Labor Code.

- reaches trực tiếp bóng đá k+ retirement age specified in Article 169 of this Labor Code, unless otherwise agreed by trực tiếp bóng đá k+ parties; or

- finds that trực tiếp bóng đá k+ employer fails to provide truthful information in accordance with Clause 1 Article 16 of this Labor Code in a manner that affects trực tiếp bóng đá k+ performance of trực tiếp bóng đá k+ employment contract.

Thus, employees who quit their jobs do not necessarily need trực tiếp bóng đá k+ consent of trực tiếp bóng đá k+ company. trực tiếp bóng đá k+ law allows trực tiếp bóng đá k+ employee to only need to notify trực tiếp bóng đá k+ employer in advance or to have trực tiếp bóng đá k+ reasons without prior notice prescribed by trực tiếp bóng đá k+ law.
