Problem no.1. If a person who is 18 years old commits a crime but was previously convicted when he was less than 16 years old, is he/she a "first-time offender"?

Answers:

According to xem bóng đá trực tiếp nhà cái provisions of Point a, Clause 1, Article 107 of xem bóng đá trực tiếp nhà cáiPenal Code, convicted persons aged between 14 and 16  are considered to have no criminal record. Therefore, if a person who is at least 18 years old commits a crime but was previously convicted when he was less than 16 years old, he/she falls under xem bóng đá trực tiếp nhà cái category of "first-time offender".

Problem no. 2.In case xem bóng đá trực tiếp nhà cái material evidence is part of an endangered, wild, or rare animal, how should xem bóng đá trực tiếp nhà cái court handle it?

Answers:

According to Clause 1 of Article 7 ofNghị quyết 05/2018/NQ-HĐTPdated November 5, 2018 of xem bóng đá trực tiếp nhà cái Council of Judges of xem bóng đá trực tiếp nhà cái Supreme People's Court, guiding xem bóng đá trực tiếp nhà cái application of Article 234 on Offences against regulations on management and protection of wild animals and Article 244 on Offences against regulations on management and protection of endangered, rare animals of xem bóng đá trực tiếp nhà cái Penal Code:

"1. Handling of wild, endangered or rare animals and their products as material evidence shall be required in xem bóng đá trực tiếp nhà cái following cases:

a. If xem bóng đá trực tiếp nhà cái material evidence is living wild, endangered or rare animals, then right after xem bóng đá trực tiếp nhà cái inspection result is received, they shall be handed over to xem bóng đá trực tiếp nhà cái specialized management agency in order for this agency to release them back into xem bóng đá trực tiếp nhà cái wild or hand them over to xem bóng đá trực tiếp nhà cái rescue center, nature reserves, national park or other agencies and organizations as regulated by laws.

b. If xem bóng đá trực tiếp nhà cái material evidence is dead animals or xem bóng đá trực tiếp nhà cái products made from wild, endangered or rare animals are easily damaged, then right after xem bóng đá trực tiếp nhà cái inspection result is received, they shall be disposed or handed over to xem bóng đá trực tiếp nhà cái specialized management agency for handling as regulated by laws.

c. Other material evidence unspecified in clause 1a and 1b of this Article shall be confiscated or disposed as regulated by laws."

Answers:

In case a person destroys property in a historical-cultural relic site or a scenic spot, but xem bóng đá trực tiếp nhà cái act of destruction has caused xem bóng đá trực tiếp nhà cái property of xem bóng đá trực tiếp nhà cái relic site to be damaged or lose its use value, xem bóng đá trực tiếp nhà cái person shall be examined for penal liability for xem bóng đá trực tiếp nhà cái crime of destroying or intentionally damaging property as prescribed in Article 178 of xem bóng đá trực tiếp nhà cái Penal Code if there are sufficient elements constituting xem bóng đá trực tiếp nhà cái crime.

2. Regarding xem bóng đá trực tiếp nhà cái field of Criminal Procedure in Vietnam

Problem no. 1.xem bóng đá trực tiếp nhà cái defendant committed many crimes; xem bóng đá trực tiếp nhà cái prosecution prosecuted these offenses but only for one crime. Answers:

If xem bóng đá trực tiếp nhà cái case can be settled in xem bóng đá trực tiếp nhà cái same case, when settling xem bóng đá trực tiếp nhà cái part of civil liability for compensation for damage, xem bóng đá trực tiếp nhà cái court shall bring xem bóng đá trực tiếp nhà cái defendant's property heir to participate in xem bóng đá trực tiếp nhà cái proceedings as a person with related interests and obligations. Pursuant to xem bóng đá trực tiếp nhà cái provisions of Article 30 of xem bóng đá trực tiếp nhà cái Criminal Procedure Code, xem bóng đá trực tiếp nhà cái court separates xem bóng đá trực tiếp nhà cái civil case (which settles xem bóng đá trực tiếp nhà cái compensation obligation between other defendants and xem bóng đá trực tiếp nhà cái defendant's heirs) according to civil procedures.

Problem no. 3.In xem bóng đá trực tiếp nhà cái same criminal case with many defendants, each defendant is prosecuted under different sections of xem bóng đá trực tiếp nhà cái same law or prosecuted under different crimes. Therefore, xem bóng đá trực tiếp nhà cái time limit for temporary detention of xem bóng đá trực tiếp nhà cái accused and defendants for trial preparation is calculated according to xem bóng đá trực tiếp nhà cái time limit of xem bóng đá trực tiếp nhà cái accused and defendants with xem bóng đá trực tiếp nhà cái longest temporary detention period or calculated according to xem bóng đá trực tiếp nhà cái temporary detention time of each type of crime corresponding to each accused or defendant?

Answers:

This issue was previously guided inNghị quyết số 04/2004/NQ-HĐTPdated November 5, 2004 of xem bóng đá trực tiếp nhà cái Council of Judges of xem bóng đá trực tiếp nhà cái Supreme People's Court guiding xem bóng đá trực tiếp nhà cái implementation of a number of regulations in xem bóng đá trực tiếp nhà cái third part of xem bóng đá trực tiếp nhà cái "first-instance trial" of xem bóng đá trực tiếp nhà cáilịch trực tiếp bóng đá hôm nay. Through xem bóng đá trực tiếp nhà cái review, it was found that xem bóng đá trực tiếp nhà cái content of xem bóng đá trực tiếp nhà cái guidance in this Resolution is still consistent with xem bóng đá trực tiếp nhà cái provisions of xem bóng đá trực tiếp nhà cái Criminal Procedure Code 2015.
