1. Penalties for “transmission of HIV to others” and “deliberate transmission of HIV to others” in Vietnam

Pursuant to Article 148 of trực tiếp bóng đá hôm nay euroxem bóng đá trực tiếp (Law No. 12/2017/QH14) stipulating penalties for trực tiếp bóng đá hôm nay euro act of transmission of HIV to others:

+ trực tiếp bóng đá hôm nay euro offence is committed against a person aged under 18, except in trực tiếp bóng đá hôm nay euro circumstances specified in Article 142 and Article 145 of trực tiếp bóng đá hôm nay euroxem bóng đá trực tiếp (Law No. 12/2017/QH14);

+ trực tiếp bóng đá hôm nay euro offence is committed against a woman with trực tiếp bóng đá hôm nay euro full knowledge of her pregnancy;

+ trực tiếp bóng đá hôm nay euro offence is committed against trực tiếp bóng đá hôm nay euro physician or health worker who directly provides treatment for trực tiếp bóng đá hôm nay euro offender;

+ trực tiếp bóng đá hôm nay euro offence is committed against a law enforcement officer in performance of his/her official duties or because of his/her official duties.

Pursuant to Article 149 of trực tiếp bóng đá hôm nay euroxem bóng đá trực tiếp (Law No. 12/2017/QH14) stipulating penalties for trực tiếp bóng đá hôm nay euro act of deliberate transmission of HIV to others:

- Any person who deliberately transmits HIV to another person in circumstances other than those specified in Article 148 of trực tiếp bóng đá hôm nay euroxem bóng đá trực tiếp (Law No. 12/2017/QH14) shall face a penalty of 03 - 07 years' imprisonment.

- This offence committed in any of trực tiếp bóng đá hôm nay euro following circumstances carries a penalty of 07 - 15 years' imprisonment:

+ trực tiếp bóng đá hôm nay euro offence is committed by an organized group;

+ trực tiếp bóng đá hôm nay euro offence is committed against a law enforcement officer in performance of his/her duty or because of his/her official duties;

+ trực tiếp bóng đá hôm nay euro offence is committed against a person under 18;

+ trực tiếp bóng đá hôm nay euro offence is committed against 02 - 05 people.

+ trực tiếp bóng đá hôm nay euro offence is committed by taking advantage of trực tiếp bóng đá hôm nay euro offender's profession;

+ trực tiếp bóng đá hôm nay euro victim suffers from 31% - 60% mental and behavioral disability because of trực tiếp bóng đá hôm nay euro offence.

- This offence committed in any of trực tiếp bóng đá hôm nay euro following circumstances carries a penalty of 12 - 20 years' imprisonment or life imprisonment:

+ trực tiếp bóng đá hôm nay euro offence is committed against a woman with trực tiếp bóng đá hôm nay euro full knowledge of her pregnancy;

+ trực tiếp bóng đá hôm nay euro offence is committed against 06 or more people;

+ trực tiếp bóng đá hôm nay euro victim suffers from ≥ 61% mental and behavioral disability because of trực tiếp bóng đá hôm nay euro offence;

+ trực tiếp bóng đá hôm nay euro offence results in trực tiếp bóng đá hôm nay euro suicide of trực tiếp bóng đá hôm nay euro victim.

- trực tiếp bóng đá hôm nay euro offender might be prohibited from holding certain positions, practicing his/her profession or doing certain jobs for 01 - 05 years.

2. Differences between “transmission of HIV to others” and “deliberate transmission of HIV to others”

Many people may confuse trực tiếp bóng đá hôm nay euro two offences of "transmission of HIV to others" and "deliberate transmission of HIV to others". Both offences involve deliberately causing trực tiếp bóng đá hôm nay euro victim to be infected with trực tiếp bóng đá hôm nay euro HIV virus. - Subjective aspect:
+ Offence of transmission of HIV to others: It is committed by a person who has trực tiếp bóng đá hôm nay euro criminal responsibility capacity, meets trực tiếp bóng đá hôm nay euro age requirement according to trực tiếp bóng đá hôm nay euro law, and is currently infected with HIV.

+ Offence of deliberate transmission of HIV to others: It is committed by a person who has trực tiếp bóng đá hôm nay euro criminal responsibility capacity and meets trực tiếp bóng đá hôm nay euro age requirement according to trực tiếp bóng đá hôm nay euro law.

Therefore, depending on trực tiếp bóng đá hôm nay euro perpetrator, trực tiếp bóng đá hôm nay euro severity, trực tiếp bóng đá hôm nay euro behavior, and trực tiếp bóng đá hôm nay euro nature of trực tiếp bóng đá hôm nay euro case, deliberately causing someone to be infected with HIV can prosecuted for trực tiếp bóng đá hôm nay euro offence of "transmission of HIV to others" or trực tiếp bóng đá hôm nay euro offence of "deliberate transmission of HIV to others."

3. Judgment on trực tiếp bóng đá hôm nay euro offence of deliberate transmission of HIV to others in Vietnam
