Issue 1:In a commercial case, after xem bóng đá trực tiếp nhà cái Court has accepted xem bóng đá trực tiếp nhà cái case, xem bóng đá trực tiếp nhà cái person who pledged xem bóng đá trực tiếp nhà cái property (xem bóng đá trực tiếp nhà cái person with relevant rights and obligations) passes away. xem bóng đá trực tiếp nhà cái plaintiff and xem bóng đá trực tiếp nhà cái Court are unable to determine xem bóng đá trực tiếp nhà cái residence of xem bóng đá trực tiếp nhà cái inheritor and xem bóng đá trực tiếp nhà cái litigation rights and obligations of xem bóng đá trực tiếp nhà cái person with relevant rights and obligations. xem bóng đá trực tiếp nhà cái Court, based on Article 214(1) of xem bóng đá trực tiếp nhà cáiCode No. 92/2015/QH13 dated, temporarily suspends xem bóng đá trực tiếp nhà cái case. In such a case where xem bóng đá trực tiếp nhà cái residence of xem bóng đá trực tiếp nhà cái inheritor and xem bóng đá trực tiếp nhà cái litigation rights and obligations mentioned above cannot be determined, how does xem bóng đá trực tiếp nhà cái Court handle it?

Answer:

According to Article 74(1) of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015 regarding xem bóng đá trực tiếp nhà cái inheritance of rights and litigation obligations, if xem bóng đá trực tiếp nhà cái litigant is an individual involved in xem bóng đá trực tiếp nhà cái litigation and passes away while their property rights and obligations are inherited, xem bóng đá trực tiếp nhà cái inheritor of that person shall participate in xem bóng đá trực tiếp nhà cái litigation.

In cases where xem bóng đá trực tiếp nhà cái plaintiff and xem bóng đá trực tiếp nhà cái Court cannot determine xem bóng đá trực tiếp nhà cái residence of xem bóng đá trực tiếp nhà cái inheritor and xem bóng đá trực tiếp nhà cái litigation rights and obligations of xem bóng đá trực tiếp nhà cái person with relevant rights and obligations, xem bóng đá trực tiếp nhà cái Court shall apply Article 214(1) of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015 to temporarily suspend xem bóng đá trực tiếp nhà cái case. At xem bóng đá trực tiếp nhà cái same time, xem bóng đá trực tiếp nhà cái Court shall instruct xem bóng đá trực tiếp nhà cái plaintiff to request xem bóng đá trực tiếp nhà cái Court to search for xem bóng đá trực tiếp nhà cái absent person at their place of residence (as regulated in Chapter XXV of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015) or request xem bóng đá trực tiếp nhà cái Court to declare a missing person (as regulated in Chapter XXVI of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015) regarding xem bóng đá trực tiếp nhà cái inheritor's litigation rights and obligations. After obtaining xem bóng đá trực tiếp nhà cái results of xem bóng đá trực tiếp nhà cái search for xem bóng đá trực tiếp nhà cái absent person at their place of residence or issuing a decision declaring a missing person regarding xem bóng đá trực tiếp nhà cái inheritor's litigation rights and obligations, xem bóng đá trực tiếp nhà cái Court shall continue to handle xem bóng đá trực tiếp nhà cái case according to general procedures.

Issue 2:In a dispute over a credit contract, with xem bóng đá trực tiếp nhà cái bank as xem bóng đá trực tiếp nhà cái plaintiff, xem bóng đá trực tiếp nhà cái Court must examine xem bóng đá trực tiếp nhà cái legality of xem bóng đá trực tiếp nhà cái collateral contract that xem bóng đá trực tiếp nhà cái bank has appraised prior to granting xem bóng đá trực tiếp nhà cái loan, as a basis for resolving xem bóng đá trực tiếp nhà cái case. In cases where xem bóng đá trực tiếp nhà cái bank has appraised xem bóng đá trực tiếp nhà cái collateral but a third party is currently using xem bóng đá trực tiếp nhà cái collateral (using xem bóng đá trực tiếp nhà cái land or living in a house on xem bóng đá trực tiếp nhà cái land), should xem bóng đá trực tiếp nhà cái Court require these individuals to participate in xem bóng đá trực tiếp nhà cái litigation as persons with relevant rights and obligations?

Answer:

According to Article 68(4) of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015:

"4. Persons with relevant rights and obligations in a civil case are those who, although not initiating or being sued, their rights and obligations are related to xem bóng đá trực tiếp nhà cái resolution of xem bóng đá trực tiếp nhà cái civil case, and therefore they can propose themselves or be proposed by other litigants and accepted by xem bóng đá trực tiếp nhà cái Court to participate in xem bóng đá trực tiếp nhà cái litigation as persons with relevant rights and obligations.

In cases where xem bóng đá trực tiếp nhà cái resolution of a civil case is related to someone's rights and obligations but no one proposes their participation in xem bóng đá trực tiếp nhà cái litigation as persons with relevant rights and obligations, xem bóng đá trực tiếp nhà cái Court must bring them into xem bóng đá trực tiếp nhà cái litigation as persons with relevant rights and obligations."

In this case, xem bóng đá trực tiếp nhà cái Court must consider whether xem bóng đá trực tiếp nhà cái resolution of xem bóng đá trực tiếp nhà cái case is related to xem bóng đá trực tiếp nhà cái rights and obligations of this third party. If it is related to their rights and obligations, xem bóng đá trực tiếp nhà cái Court must include them in xem bóng đá trực tiếp nhà cái litigation as persons with relevant rights and obligations.

Issue 3:In a dispute over a credit contract, xem bóng đá trực tiếp nhà cái borrower used their own land and house on xem bóng đá trực tiếp nhà cái land as collateral to secure xem bóng đá trực tiếp nhà cái repayment obligation under xem bóng đá trực tiếp nhà cái credit contract. Afterwards, a third party demolished xem bóng đá trực tiếp nhà cái old house to build a new one on xem bóng đá trực tiếp nhà cái land. xem bóng đá trực tiếp nhà cái third party knew that xem bóng đá trực tiếp nhà cái land and xem bóng đá trực tiếp nhà cái old house were used as collateral for xem bóng đá trực tiếp nhà cái bank but did not inform xem bóng đá trực tiếp nhà cái bank, and xem bóng đá trực tiếp nhà cái bank was also unaware of xem bóng đá trực tiếp nhà cái third party's construction of a new house on xem bóng đá trực tiếp nhà cái land. xem bóng đá trực tiếp nhà cái borrower failed to repay xem bóng đá trực tiếp nhà cái debt on time and was sued by xem bóng đá trực tiếp nhà cái bank. When resolving xem bóng đá trực tiếp nhà cái dispute, does xem bóng đá trực tiếp nhà cái Court need to assess xem bóng đá trực tiếp nhà cái value of xem bóng đá trực tiếp nhà cái new house generated on xem bóng đá trực tiếp nhà cái land, and how should it handle this newly generated asset?

Answer:

xem bóng đá trực tiếp nhà cái new house built by xem bóng đá trực tiếp nhà cái third party on xem bóng đá trực tiếp nhà cái land is an asset that arose after xem bóng đá trực tiếp nhà cái borrower pledged xem bóng đá trực tiếp nhà cái land use rights to xem bóng đá trực tiếp nhà cái bank under xem bóng đá trực tiếp nhà cái collateral contract signed between xem bóng đá trực tiếp nhà cái borrower and xem bóng đá trực tiếp nhà cái bank. Therefore, when resolving xem bóng đá trực tiếp nhà cái case, xem bóng đá trực tiếp nhà cái Court must include xem bóng đá trực tiếp nhà cái third party in xem bóng đá trực tiếp nhà cái litigation as a person with relevant rights and obligations. xem bóng đá trực tiếp nhà cái Court must rely on xem bóng đá trực tiếp nhà cái agreements of xem bóng đá trực tiếp nhà cái parties in xem bóng đá trực tiếp nhà cái collateral contract and xem bóng đá trực tiếp nhà cái requests of xem bóng đá trực tiếp nhà cái litigants to determine whether to assess xem bóng đá trực tiếp nhà cái value of this new house. If xem bóng đá trực tiếp nhà cái assessment of this asset is necessary and xem bóng đá trực tiếp nhà cái result of xem bóng đá trực tiếp nhà cái assessment has practical value in xem bóng đá trực tiếp nhà cái process of resolving xem bóng đá trực tiếp nhà cái case, xem bóng đá trực tiếp nhà cái Court must proceed with xem bóng đá trực tiếp nhà cái assessment of this asset.

If xem bóng đá trực tiếp nhà cái borrowing party violates xem bóng đá trực tiếp nhà cái obligation to repay xem bóng đá trực tiếp nhà cái debt, according to xem bóng đá trực tiếp nhà cái request of xem bóng đá trực tiếp nhà cái bank, xem bóng đá trực tiếp nhà cái court will declare xem bóng đá trực tiếp nhà cái seizure of assets, which includes xem bóng đá trực tiếp nhà cái right to use land and assets on xem bóng đá trực tiếp nhà cái land to fulfill xem bóng đá trực tiếp nhà cái debt repayment obligation of xem bóng đá trực tiếp nhà cái borrower. During xem bóng đá trực tiếp nhà cái enforcement process, a third party has xem bóng đá trực tiếp nhà cái priority right to receive xem bóng đá trực tiếp nhà cái transfer of land use rights and purchase assets attached to xem bóng đá trực tiếp nhà cái land if desired. In xem bóng đá trực tiếp nhà cái case that xem bóng đá trực tiếp nhà cái third party does not receive xem bóng đá trực tiếp nhà cái transfer of land use rights and does not purchase assets attached to xem bóng đá trực tiếp nhà cái land, they will be compensated for xem bóng đá trực tiếp nhà cái value of their assets on xem bóng đá trực tiếp nhà cái land according to xem bóng đá trực tiếp nhà cái provisions of xem bóng đá trực tiếp nhà cái law.

Issue 4:According to xem bóng đá trực tiếp nhà cái provisions of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015, xem bóng đá trực tiếp nhà cái parties have xem bóng đá trực tiếp nhà cái right to agree to invite an independent valuation organization. After xem bóng đá trực tiếp nhà cái valuation, xem bóng đá trực tiếp nhà cái parties will rely on xem bóng đá trực tiếp nhà cái valuation certificate issued by xem bóng đá trực tiếp nhà cái valuation organization to resolve xem bóng đá trực tiếp nhà cái dispute. However, if only one of xem bóng đá trực tiếp nhà cái parties agrees to invite a valuation organization and xem bóng đá trực tiếp nhà cái other party does not agree, how is this case handled?

Answer:Clause 2, Article 104 of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015 stipulates:

"2. xem bóng đá trực tiếp nhà cái parties have xem bóng đá trực tiếp nhà cái right to agree on xem bóng đá trực tiếp nhà cái selection of an asset valuation organization to conduct xem bóng đá trực tiếp nhà cái valuation of assets and provide xem bóng đá trực tiếp nhà cái valuation results to xem bóng đá trực tiếp nhà cái court.

xem bóng đá trực tiếp nhà cái valuation of assets shall be conducted in accordance with xem bóng đá trực tiếp nhà cái provisions of xem bóng đá trực tiếp nhà cái law on asset valuation."

According to xem bóng đá trực tiếp nhà cái above regulations, xem bóng đá trực tiếp nhà cái parties in xem bóng đá trực tiếp nhà cái case have xem bóng đá trực tiếp nhà cái right to agree on xem bóng đá trực tiếp nhà cái selection of an asset valuation organization to conduct xem bóng đá trực tiếp nhà cái valuation of assets and provide xem bóng đá trực tiếp nhà cái valuation results to xem bóng đá trực tiếp nhà cái court to resolve xem bóng đá trực tiếp nhà cái dispute. xem bóng đá trực tiếp nhà cái valuation of assets shall be conducted in accordance with xem bóng đá trực tiếp nhà cái provisions of xem bóng đá trực tiếp nhà cái law on asset valuation. However, in xem bóng đá trực tiếp nhà cái case where only one of xem bóng đá trực tiếp nhà cái parties agrees to invite an asset valuation organization to conduct xem bóng đá trực tiếp nhà cái valuation of assets and xem bóng đá trực tiếp nhà cái other parties do not agree, it means that xem bóng đá trực tiếp nhà cái parties cannot agree on xem bóng đá trực tiếp nhà cái selection of an asset valuation organization to conduct xem bóng đá trực tiếp nhà cái valuation of assets. Therefore, xem bóng đá trực tiếp nhà cái court must make a decision on xem bóng đá trực tiếp nhà cái valuation of assets and establish a valuation council according to xem bóng đá trực tiếp nhà cái provisions in point b, clause 3, Article 104 of xem bóng đá trực tiếp nhà cái Civil Procedure Code 2015 as a basis for resolving xem bóng đá trực tiếp nhà cái case.

Issue 5:When resolving disputes on credit contracts between xem bóng đá trực tiếp nhà cái plaintiff, who is a bank, and xem bóng đá trực tiếp nhà cái defendant, who is an individual business household, with xem bóng đá trực tiếp nhà cái household head being over 60 years old, xem bóng đá trực tiếp nhà cái individual business household borrowed money for business activities with profit purposes. Does xem bóng đá trực tiếp nhà cái person over 60 years old in this case qualify for a fee exemption according toNghị quyết 326/2016/UBTVQH14 quydated December 30, 2016, of xem bóng đá trực tiếp nhà cái National Assembly Standing Committee?

Answer:According to clause 1, Article 79 ofvtv5 trực tiếp bóng đá hômdated January 4, 2021: "1. An individual or household members register and establish a business household and take full responsibility for xem bóng đá trực tiếp nhà cái business activities of xem bóng đá trực tiếp nhà cái household with their entire assets. In xem bóng đá trực tiếp nhà cái event that household members register a business household, they authorize one member to represent xem bóng đá trực tiếp nhà cái business household. xem bóng đá trực tiếp nhà cái individual who registers a business household, xem bóng đá trực tiếp nhà cái person authorized by household members to represent xem bóng đá trực tiếp nhà cái business household, is xem bóng đá trực tiếp nhà cái household head of xem bóng đá trực tiếp nhà cái business household." According to clause 2, Article 81 of Decree No. 01/2021/NĐ-CP dated January 4, 2021, xem bóng đá trực tiếp nhà cái household head represents xem bóng đá trực tiếp nhà cái business household as xem bóng đá trực tiếp nhà cái requesting party in civil proceedings, xem bóng đá trực tiếp nhà cái plaintiff, xem bóng đá trực tiếp nhà cái defendant, xem bóng đá trực tiếp nhà cái person with rights and obligations related to xem bóng đá trực tiếp nhà cái arbitration, and xem bóng đá trực tiếp nhà cái Court.

In this case, xem bóng đá trực tiếp nhà cái household head is only representing xem bóng đá trực tiếp nhà cái business household participating in xem bóng đá trực tiếp nhà cái litigation at xem bóng đá trực tiếp nhà cái Court, so xem bóng đá trực tiếp nhà cái business household is xem bóng đá trực tiếp nhà cái subject that must pay xem bóng đá trực tiếp nhà cái fees, not xem bóng đá trực tiếp nhà cái household head. Therefore, if xem bóng đá trực tiếp nhà cái household head is over 60 years old, they are not eligible for a fee exemption according to xem bóng đá trực tiếp nhà cái provisions in point d, clause 1, Article 12 of Resolution No. 326/2016/UBTVQH14 dated December 30, 2016, of xem bóng đá trực tiếp nhà cái National Assembly Standing Committee.
