Dissolution of securities investment funds

1. A securities investment fund shall be dissolved in lịch trực tiếp bóng đá hôm nay following cases:

a) lịch trực tiếp bóng đá hôm nay operation period written in lịch trực tiếp bóng đá hôm nay fund’s charter expires;

b) lịch trực tiếp bóng đá hôm nay General Meeting of Investors decides to dissolve lịch trực tiếp bóng đá hôm nay fund ahead of schedule;

c) lịch trực tiếp bóng đá hôm nay fund management company has its securities trading license revoked or is dissolved or goes bankrupt and a substitute fund management company is not appointed by lịch trực tiếp bóng đá hôm nay representative board of lịch trực tiếp bóng đá hôm nay fund within 02 months from lịch trực tiếp bóng đá hôm nay event;

d) lịch trực tiếp bóng đá hôm nay supervisory bank has its certificate of securities depository registration revoked or is dissolved or goes bankrupt, or lịch trực tiếp bóng đá hôm nay supervision contract between lịch trực tiếp bóng đá hôm nay supervisory bank and lịch trực tiếp bóng đá hôm nay fund management company is terminated and a substitute supervisory bank is not appointed by lịch trực tiếp bóng đá hôm nay fund management company within 02 months from lịch trực tiếp bóng đá hôm nay event;

As regulated above, a securities investment fund shall be dissolved in lịch trực tiếp bóng đá hôm nay following cases:

- lịch trực tiếp bóng đá hôm nay operation period written in lịch trực tiếp bóng đá hôm nay fund’s charter expires;

- lịch trực tiếp bóng đá hôm nay General Meeting of Investors decides to dissolve lịch trực tiếp bóng đá hôm nay fund ahead of schedule;

- lịch trực tiếp bóng đá hôm nay fund management company has its securities trading license revoked or is dissolved or goes bankrupt and a substitute fund management company is not appointed by lịch trực tiếp bóng đá hôm nay representative board of lịch trực tiếp bóng đá hôm nay fund within 02 months from lịch trực tiếp bóng đá hôm nay event;

- lịch trực tiếp bóng đá hôm nay net asset value of lịch trực tiếp bóng đá hôm nay fund is under 10 billion VND for 06 consecutive months;

- Other cases specified in lịch trực tiếp bóng đá hôm nay fund’s charter.

What are rights and obligations of investors in securities investment funds in Vietnam?

Pursuant to Article 101 of lịch trực tiếp bóng đá hôm nay Law on Securities in 2019 stipulating rights and obligations of investors in securities investment funds in Vietnam:

1. Investors have lịch trực tiếp bóng đá hôm nay rights to:

- Benefits from investments of lịch trực tiếp bóng đá hôm nay securities investment fund in proportion to their contributions;

- Interests and assets lawfully distributed from liquidation of assets of lịch trực tiếp bóng đá hôm nay securities investment fund;

- Request lịch trực tiếp bóng đá hôm nay fund management company to repurchase open-end fund certificates;

- File lawsuits against lịch trực tiếp bóng đá hôm nay fund management company, supervisory bank or relevant organizations if they violate their lịch trực tiếp bóng đá hôm nay lawful rights and interests;

- Execute their rights through lịch trực tiếp bóng đá hôm nay General Meeting of Investors;

- Transfer fund certificates in accordance with lịch trực tiếp bóng đá hôm nay fund’s charter;

- Exercise other rights prescribed by law and lịch trực tiếp bóng đá hôm nay fund’s charter.

2. Investors have lịch trực tiếp bóng đá hôm nay obligations to:

- Implement decisions of lịch trực tiếp bóng đá hôm nay General Meetings of Investors;

- Fully pay for lịch trực tiếp bóng đá hôm nay fund certificates;

- Fulfill other obligations prescribed by law and lịch trực tiếp bóng đá hôm nay charter of lịch trực tiếp bóng đá hôm nay securities investment fund.

What are rights and obligations of lịch trực tiếp bóng đá hôm nay General Meeting of Investors of securities investment funds in Vietnam?

Pursuant to Clause 2 Article 102 of lịch trực tiếp bóng đá hôm nay Law on Securities in 2019, lịch trực tiếp bóng đá hôm nay General Meeting of Investors has lịch trực tiếp bóng đá hôm nay following rights and obligations:

- Elect, dismiss lịch trực tiếp bóng đá hôm nay chairperson and members of lịch trực tiếp bóng đá hôm nay representative board of lịch trực tiếp bóng đá hôm nay securities investment fund;

- Decide lịch trực tiếp bóng đá hôm nay wages and operating cost of lịch trực tiếp bóng đá hôm nay representative board;

- Decide fundamental changes in investment policies, profit distribution and investment objectives of lịch trực tiếp bóng đá hôm nay fund; decide change of lịch trực tiếp bóng đá hôm nay fund management company and supervisory bank; change of payment to lịch trực tiếp bóng đá hôm nay fund management company and supervisory bank;

- Decide revisions to lịch trực tiếp bóng đá hôm nay fund’s charter;

- Decide division, consolidation, merger, dissolution of lịch trực tiếp bóng đá hôm nay securities investment fund; change of lịch trực tiếp bóng đá hôm nay charter capital or operating period of lịch trực tiếp bóng đá hôm nay securities investment fund;

- Request lịch trực tiếp bóng đá hôm nay fund management company and supervisory bank to present transaction documents at lịch trực tiếp bóng đá hôm nay meeting;

- Approve annual reports on lịch trực tiếp bóng đá hôm nay fund’s finance, assets and operation; select accredited audit organization to audit lịch trực tiếp bóng đá hôm nay fund’s annual financial statements;

- Take actions against violations committed by lịch trực tiếp bóng đá hôm nay fund management company, supervisory bank and representative board if they cause damage to lịch trực tiếp bóng đá hôm nay fund;

- Exercise other rights and obligation prescribed by law and lịch trực tiếp bóng đá hôm nay fund’s charter.
