What are regulations on transfer of cases to prosecution according to competence; assignment of kết quả bóng đá trực tiếp exercise of kết quả bóng đá trực tiếp right to prosecution and first-instance trial supervision in Vietnam?

In Article 72 of kết quả bóng đá trực tiếp Regulation on kết quả bóng đá trực tiếp exercise of kết quả bóng đá trực tiếp right to prosecute, supervise kết quả bóng đá trực tiếp prosecution, investigation and prosecution issued together with Decision 111/QD-VKSTC in 2020, there is a provision on transfer of cases to prosecution according to competence; assignment of kết quả bóng đá trực tiếp exercise of kết quả bóng đá trực tiếp right to prosecution and first-instance trial supervision are prescribed as follows:

1. After finishing kết quả bóng đá trực tiếp investigation of kết quả bóng đá trực tiếp case, if finding that kết quả bóng đá trực tiếp case is not within their prosecution competence, kết quả bóng đá trực tiếp procurator shall report and propose kết quả bóng đá trực tiếp unit's leader or kết quả bóng đá trực tiếp Institute's leader to issue a decision to transfer kết quả bóng đá trực tiếp case to kết quả bóng đá trực tiếp Procuracy. Prosecutors have kết quả bóng đá trực tiếp authority to prosecute according to kết quả bóng đá trực tiếp provisions of Clause 1, Article 239 of kết quả bóng đá trực tiếp Criminal Procedure Code. kết quả bóng đá trực tiếp Procuracy competent to prosecute, when receiving kết quả bóng đá trực tiếp dossier, must assign kết quả bóng đá trực tiếp procurator to study and report, and propose kết quả bóng đá trực tiếp unit's leader and kết quả bóng đá trực tiếp Institute's leader to settle as follows:

a) If they agree with kết quả bóng đá trực tiếp investigation conclusion and kết quả bóng đá trực tiếp prosecution request of kết quả bóng đá trực tiếp investigating authority, they shall issue an indictment to prosecute kết quả bóng đá trực tiếp accused to a competent court. If kết quả bóng đá trực tiếp Court returns kết quả bóng đá trực tiếp file to kết quả bóng đá trực tiếp Procuracy for additional investigation, kết quả bóng đá trực tiếp Procuracy that has prosecuted must transfer kết quả bóng đá trực tiếp file to kết quả bóng đá trực tiếp Procuracy that has exercised its right to prosecute and investigate to carry out kết quả bóng đá trực tiếp procedures for returning kết quả bóng đá trực tiếp file to kết quả bóng đá trực tiếp Procuracy. kết quả bóng đá trực tiếp agency has investigated and issued a decision to transfer kết quả bóng đá trực tiếp case to kết quả bóng đá trực tiếp competent investigating agency;

b) If you do not agree with kết quả bóng đá trực tiếp investigation conclusion proposed to prosecute by kết quả bóng đá trực tiếp investigating authority, kết quả bóng đá trực tiếp file shall be returned to kết quả bóng đá trực tiếp Procuracy that has exercised kết quả bóng đá trực tiếp right to prosecute and investigate to carry out procedures for transferring kết quả bóng đá trực tiếp case to kết quả bóng đá trực tiếp competent investigative agency.

2. For cases where kết quả bóng đá trực tiếp superior procuracies exercise kết quả bóng đá trực tiếp right to prosecute and investigate, kết quả bóng đá trực tiếp superior procuracies shall decide to prosecute. kết quả bóng đá trực tiếp assignment of lower-level procuracies to exercise kết quả bóng đá trực tiếp right to prosecute and supervise first-instance trials shall comply with kết quả bóng đá trực tiếp provisions of Clause 1, Article 239 of kết quả bóng đá trực tiếp Criminal Procedure Code , and kết quả bóng đá trực tiếp Regulation on coordination between kết quả bóng đá trực tiếp superior procuracies and kết quả bóng đá trực tiếp procuracies. kết quả bóng đá trực tiếp superior procuracy exercises kết quả bóng đá trực tiếp right to prosecute, supervises kết quả bóng đá trực tiếp investigation and prosecution, and assigns kết quả bóng đá trực tiếp lower procuracies to exercise kết quả bóng đá trực tiếp right to prosecute and supervise kết quả bóng đá trực tiếp first trial promulgated together with Decision No. 314/QD-VKSTC dated July 5, 2018 of kết quả bóng đá trực tiếp Procurator General of kết quả bóng đá trực tiếp Supreme People's Procuracy and other relevant regulations.

What is exercise of kết quả bóng đá trực tiếp right to prosecute and supervise kết quả bóng đá trực tiếp application of proceedings against persons under 18 years of age in Vietnam?

In Article 73 of kết quả bóng đá trực tiếp Regulation on kết quả bóng đá trực tiếp exercise of kết quả bóng đá trực tiếp right to prosecute, supervise kết quả bóng đá trực tiếp prosecution, investigation and prosecution issued together with Decision 111/QD-VKSTC in 2020, there are provisions on exercise of kết quả bóng đá trực tiếp right to prosecute and supervise kết quả bóng đá trực tiếp application of proceedings against persons under 18 years of age shall be applied as follows:

1. When exercising kết quả bóng đá trực tiếp right to prosecute, supervise kết quả bóng đá trực tiếp application of procedures to accused persons, victims and witnesses who are under 18 years old, procurators must closely supervise and ensure kết quả bóng đá trực tiếp implementation comply with kết quả bóng đá trực tiếp provisions of Chapter XXVIII, other provisions of kết quả bóng đá trực tiếp Criminal Procedure Code on procedures for persons under 18 years of age, relevant laws and this Regulation.

2. In a criminal case where kết quả bóng đá trực tiếp accused person is a person under kết quả bóng đá trực tiếp age of 18, if it is discovered that kết quả bóng đá trực tiếp investigator has not clearly determined kết quả bóng đá trực tiếp age, level of physical and mental development, level of awareness of behavior committing crimes, living and educational conditions, whether or not there is a person aged full 18 years or older inciting, causes, conditions and circumstances of kết quả bóng đá trực tiếp crime of a person under 18 years old, kết quả bóng đá trực tiếp procurator shall request kết quả bóng đá trực tiếp investigator to comply with kết quả bóng đá trực tiếp provisions of Article 416 of kết quả bóng đá trực tiếp Criminal Procedure Code.

3. If it is found that there are sufficient grounds for criminal prosecution of persons under 18 years of age who commit crimes, kết quả bóng đá trực tiếp procuratorate shall report and propose to kết quả bóng đá trực tiếp unit leader or kết quả bóng đá trực tiếp Institute leader to issue a decision approving kết quả bóng đá trực tiếp decision to prosecute kết quả bóng đá trực tiếp accused; consider kết quả bóng đá trực tiếp approval of arrest warrants, decisions on extension of custody and temporary detention orders by investigating agencies as prescribed in Article 419 of kết quả bóng đá trực tiếp Criminal Procedure Code; if finding that there are not enough grounds, they shall report and propose to kết quả bóng đá trực tiếp leaders of kết quả bóng đá trực tiếp units, kết quả bóng đá trực tiếp leaders of kết quả bóng đá trực tiếp Institute not to approve kết quả bóng đá trực tiếp decision to prosecute kết quả bóng đá trực tiếp accused and other procedural decisions.

4. If it is found that a person under 18 years of age has sufficient grounds, conditions and is eligible for criminal liability exemption and application of supervision and education measures as prescribed in Clause 2, Article 91, provisions of Article 92, 93, 94 and 95 of kết quả bóng đá trực tiếp Penal Code, kết quả bóng đá trực tiếp Procurator shall report and propose to kết quả bóng đá trực tiếp unit leader and kết quả bóng đá trực tiếp Institute leader to settle as follows:

a) If kết quả bóng đá trực tiếp case has not been finished with investigation, it shall issue a written request to kết quả bóng đá trực tiếp investigating authority to issue a decision to terminate kết quả bóng đá trực tiếp investigation or investigation of kết quả bóng đá trực tiếp accused, exempt from criminal liability and apply other measures of supervision and education according to kết quả bóng đá trực tiếp provisions of Articles 230, 427, 428 and 429 of kết quả bóng đá trực tiếp Criminal Procedure Code;

b) If kết quả bóng đá trực tiếp case is in kết quả bóng đá trực tiếp prosecution stage, issue a decision to terminate kết quả bóng đá trực tiếp case or terminate kết quả bóng đá trực tiếp case against kết quả bóng đá trực tiếp accused, exempt from penal liability and apply supervision and education measures as prescribed in Clause 1 of this Article. Articles 248, 427, 428 and 429 of kết quả bóng đá trực tiếp Criminal Procedure Code.

What are regulations on exercise of kết quả bóng đá trực tiếp right to prosecute and supervise kết quả bóng đá trực tiếp application of kết quả bóng đá trực tiếp measure of compulsory medical treatment in Vietnam?

In Article 74 of kết quả bóng đá trực tiếp Regulation on kết quả bóng đá trực tiếp exercise of kết quả bóng đá trực tiếp right to prosecute, supervise kết quả bóng đá trực tiếp prosecution, investigation and prosecution issued together with Decision 111/QD-VKSTC in 2020, there are provisions on exercise of kết quả bóng đá trực tiếp right to prosecute and supervise kết quả bóng đá trực tiếp application of kết quả bóng đá trực tiếp measure of compulsory medical treatment is prescribed as follows:

1. When there is a suspicion that kết quả bóng đá trực tiếp accused person has a mental illness or another disease that causes him to lose kết quả bóng đá trực tiếp ability to perceive or control his behavior, kết quả bóng đá trực tiếp procurator must promptly report and propose to kết quả bóng đá trực tiếp unit leader or leader. kết quả bóng đá trực tiếp Institute deals with kết quả bóng đá trực tiếp following:

a) During kết quả bóng đá trực tiếp investigation period, if kết quả bóng đá trực tiếp investigating authority does not solicit forensic psychiatric assessment, it shall issue a written request to kết quả bóng đá trực tiếp investigating authority to solicit forensic psychiatric assessment;

b) During kết quả bóng đá trực tiếp prosecution stage, kết quả bóng đá trực tiếp Procuracy shall issue a decision to solicit forensic psychiatric assessment.

2. Within 03 days from kết quả bóng đá trực tiếp date of receipt of kết quả bóng đá trực tiếp written request for application of compulsory medical treatment measure from kết quả bóng đá trực tiếp investigating agency together with kết quả bóng đá trực tiếp conclusion of forensic mental examination, if finding sufficient grounds, kết quả bóng đá trực tiếp procurator shall report a report. Report and propose to leaders of units, leaders of Institute to solve as follows:

a) Issue a decision to apply kết quả bóng đá trực tiếp measure of compulsory medical treatment to kết quả bóng đá trực tiếp accused and request kết quả bóng đá trực tiếp investigating authority to issue a decision to suspend kết quả bóng đá trực tiếp investigation or to suspend kết quả bóng đá trực tiếp investigation of kết quả bóng đá trực tiếp accused if kết quả bóng đá trực tiếp forensic examination concludes that It is determined that at kết quả bóng đá trực tiếp time of committing kết quả bóng đá trực tiếp offence, kết quả bóng đá trực tiếp accused does not have a mental illness or another disease that causes loss of awareness or ability to control behavior;

b) Issue a decision to apply kết quả bóng đá trực tiếp measure of compulsory medical treatment to kết quả bóng đá trực tiếp accused and issue a written request to kết quả bóng đá trực tiếp investigating authority to issue a decision to terminate kết quả bóng đá trực tiếp investigation or to terminate kết quả bóng đá trực tiếp investigation of kết quả bóng đá trực tiếp accused if kết quả bóng đá trực tiếp forensic examination concludes. mentally determined at kết quả bóng đá trực tiếp time of committing kết quả bóng đá trực tiếp offence, kết quả bóng đá trực tiếp accused suffers from a mental illness or another disease that causes loss of awareness or ability to control behavior.

3. During kết quả bóng đá trực tiếp prosecution stage, if kết quả bóng đá trực tiếp Procuracy issues a decision to solicit forensic psychiatric expertise as prescribed at Point b, Clause 1 of this Article, after receiving kết quả bóng đá trực tiếp forensic psychiatric assessment conclusion, kết quả bóng đá trực tiếp procurator shall report and propose to leaders of units, leaders of kết quả bóng đá trực tiếp Institute to consider and settle according to kết quả bóng đá trực tiếp provisions of Article 450 of kết quả bóng đá trực tiếp Criminal Procedure Code.

4. If kết quả bóng đá trực tiếp content of kết quả bóng đá trực tiếp conclusion of kết quả bóng đá trực tiếp forensic psychiatric assessment is unclear or incomplete or when there is doubt that kết quả bóng đá trực tiếp conclusion of kết quả bóng đá trực tiếp forensic psychiatric assessment is incorrect, kết quả bóng đá trực tiếp additional assessment or re-examination shall be carried out in accordance with provisions of kết quả bóng đá trực tiếp Criminal Procedure Code, kết quả bóng đá trực tiếp Law on Judicial Assessment, inter-sectoral guidelines and other regulations on solicitation of expertise by kết quả bóng đá trực tiếp Supreme People's Procuracy.

5. In case kết quả bóng đá trực tiếp procuracies receive a notice from kết quả bóng đá trực tiếp head of kết quả bóng đá trực tiếp compulsory medical treatment establishment that kết quả bóng đá trực tiếp person subject to compulsory medical treatment has recovered from kết quả bóng đá trực tiếp disease, kết quả bóng đá trực tiếp procurator shall report and propose kết quả bóng đá trực tiếp unit's leader and kết quả bóng đá trực tiếp institute's leader to settle kết quả bóng đá trực tiếp matter as follows:

a) If kết quả bóng đá trực tiếp case is in kết quả bóng đá trực tiếp investigation stage, it shall issue a written request to kết quả bóng đá trực tiếp investigating authority to issue a decision to solicit an assessment of kết quả bóng đá trực tiếp current medical condition of kết quả bóng đá trực tiếp person subject to compulsory medical treatment;

b) If kết quả bóng đá trực tiếp case is in kết quả bóng đá trực tiếp prosecution stage, kết quả bóng đá trực tiếp Procuracy shall issue a decision to solicit an assessment of kết quả bóng đá trực tiếp current medical condition of kết quả bóng đá trực tiếp person subject to compulsory medical treatment.

In kết quả bóng đá trực tiếp cases mentioned at Points a and b of this Clause, if kết quả bóng đá trực tiếp assessment results conclude that kết quả bóng đá trực tiếp person subject to compulsory medical treatment has recovered from kết quả bóng đá trực tiếp disease, kết quả bóng đá trực tiếp Procuracy shall issue a decision to suspend kết quả bóng đá trực tiếp enforcement of kết quả bóng đá trực tiếp measure of compulsory medical treatment. After kết quả bóng đá trực tiếp suspension of enforcement of kết quả bóng đá trực tiếp compulsory medical treatment measure, kết quả bóng đá trực tiếp temporarily suspended proceedings may be reinstated according to kết quả bóng đá trực tiếp provisions of Article 454 of kết quả bóng đá trực tiếp Criminal Procedure Code.
