Organizational system of bóng đá hôm nay trực tiếp People's Court in Vietnam

Since bóng đá hôm nay trực tiếpLaw No. 62/2014/QH13 dated November 24, 2014took effect, bóng đá hôm nay trực tiếp organizational structure of bóng đá hôm nay trực tiếp Vietnamese Court system has undergone many changes, as well as changes in bóng đá hôm nay trực tiếp powers and responsibilities of each Court level.

Courts in our country are divided into bóng đá hôm nay trực tiếp following levels:

-bóng đá hôm nay trực tiếp Supreme People's Court.

-Superior people’s courts.

-Courts of provinces and centrally run cities.

-Courts of rural districts, urban districts, towns, provincial cities, and bóng đá hôm nay trực tiếp equivalent.

-Military courts.

1. bóng đá hôm nay trực tiếp Supreme People's Court (TSPC)

– TSPC is bóng đá hôm nay trực tiếp highest judicial body of bóng đá hôm nay trực tiếp Socialist Republic of Vietnam, conducting cassation and retrial of effective judgments and decisions of Courts at all levels that are protested in accordance with bóng đá hôm nay trực tiếp provisions of law.

– In bóng đá hôm nay trực tiếp organizational structure of bóng đá hôm nay trực tiếp TSPC, bóng đá hôm nay trực tiếp TSPC Judges' Council is bóng đá hôm nay trực tiếp body empowered to adjudicate and issue resolutions to guide Courts at all levels to uniformly apply bóng đá hôm nay trực tiếp law.

– Approval mechanism of bóng đá hôm nay trực tiếp Council of Judges: Derived from bóng đá hôm nay trực tiếp principle of collective trial and majority decision of bóng đá hôm nay trực tiếp People's Court, a meeting of bóng đá hôm nay trực tiếp Council of Judges must have at least 2/3 of bóng đá hôm nay trực tiếp total number of members participating; bóng đá hôm nay trực tiếp decision of bóng đá hôm nay trực tiếp Council of Judges must be approved by more than half of bóng đá hôm nay trực tiếp total number of members.

2. Superior people's courts (SPC)

– Compared to bóng đá hôm nay trực tiếp Court system according to bóng đá hôm nay trực tiếp provisions of bóng đá hôm nay trực tiếp Law on Organization of People's Courts in 2002, SPC is a new level of Court introduced into bóng đá hôm nay trực tiếp Vietnamese Court organization system.

Superior people's courts are a new level of Court added in bóng đá hôm nay trực tiếp Law on Organization of bóng đá hôm nay trực tiếp People's Courts 2014, taking effect on June 1, 2015. Currently, bóng đá hôm nay trực tiếp country has 3 Superior people's courts located in Hanoi, Da Nang, and Ho Chi Minh City. Thus, bóng đá hôm nay trực tiếp SPC performs both cassation and retrial functions, like bóng đá hôm nay trực tiếp TSPC.

– SPC has bóng đá hôm nay trực tiếp function of appellate trial of first-instance judgments and decisions of Courts of provinces and centrally run cities within territorial jurisdiction that have not yet taken legal effect due to appeals or protests according to bóng đá hôm nay trực tiếp provisions of procedural law; cassation and re-trial of legally effective judgments and decisions of Courts of provinces, centrally run cities, Courts of districts, districts, towns, provincial cities and equivalents within bóng đá hôm nay trực tiếp scope of jurisdiction according to bóng đá hôm nay trực tiếp protested territory according to bóng đá hôm nay trực tiếp provisions of procedural law.

Within bóng đá hôm nay trực tiếp structure of bóng đá hôm nay trực tiếp SPC, bóng đá hôm nay trực tiếp SPC Judges Committee is bóng đá hôm nay trực tiếp body empowered to organize trials, discuss, and comment on bóng đá hôm nay trực tiếp report of bóng đá hôm nay trực tiếp SPC Chief Justice.

3. Courts of provinces and centrally run cities (Courts of provinces)

– Courts of provinces perform bóng đá hôm nay trực tiếp function of first instance trial of cases falling under their jurisdiction according to bóng đá hôm nay trực tiếp provisions of procedural law; appeal judgments and decisions of Courts of districts that have not yet taken legal effect and are appealed or protested against according to bóng đá hôm nay trực tiếp provisions of procedural law; Check bóng đá hôm nay trực tiếp legally effective judgments and decisions of bóng đá hôm nay trực tiếp Courts of districts when detecting violations of bóng đá hôm nay trực tiếp law or new details, and propose to bóng đá hôm nay trực tiếp SPC Judge and TSPC Chief Judge to consider bóng đá hôm nay trực tiếp appeal.

– Courts of provinces are local courts, so bóng đá hôm nay trực tiếp law is given great authority in adjudicating and resolving cases.

– In bóng đá hôm nay trực tiếp Courts of provinces, there are specialized courts: criminal court, civil court, administrative court, economic court, labor court, family court, and juvenile court, established to directly resolve cases.

4. Courts of rural districts, urban districts, towns, provincial cities, and bóng đá hôm nay trực tiếp equivalent. (Courts of districts)

– When adjudicating and resolving cases, Courts of districts only have bóng đá hôm nay trực tiếp authority to resolve first instance cases under their jurisdiction according to bóng đá hôm nay trực tiếp provisions of procedural law.

– At bóng đá hôm nay trực tiếp district level, specialized Courts are only established at bóng đá hôm nay trực tiếp request of bóng đá hôm nay trực tiếp Chief Justice of bóng đá hôm nay trực tiếp TSPC, according to bóng đá hôm nay trực tiếp requirements and actual trials in each Courts of districts.

5. Military courts (MC)

MC levels include:

– Central MC;

– Military zone MC and equivalent;

– Regional MC

When determining case-based jurisdiction, bóng đá hôm nay trực tiếp MC only participates in resolving criminal cases according to bóng đá hôm nay trực tiếp jurisdiction delimitation of bóng đá hôm nay trực tiếp Criminal Procedure Code.

– bóng đá hôm nay trực tiếp regional MC has bóng đá hôm nay trực tiếp function of first-instance trial in criminal cases according to bóng đá hôm nay trực tiếp provisions of bóng đá hôm nay trực tiếp Criminal Procedure Code;

– Military zone MCs and equivalents have bóng đá hôm nay trực tiếp function of first-instance trials of criminal cases according to bóng đá hôm nay trực tiếp provisions of bóng đá hôm nay trực tiếpvtv2 trực tiếp bóng đá hôm; appellate trials of criminal cases in which bóng đá hôm nay trực tiếp first-instance judgment or decision of bóng đá hôm nay trực tiếp regional MC has not yet taken legal effect and is appealed or protested against;

– bóng đá hôm nay trực tiếp central MC has bóng đá hôm nay trực tiếp function of appealing criminal cases where bóng đá hôm nay trực tiếp first instance judgments and decisions of bóng đá hôm nay trực tiếp military zone MC and bóng đá hôm nay trực tiếp equivalent have not yet taken effect and are being appealed or protested against.

Thus, bóng đá hôm nay trực tiếp MC only stops at bóng đá hôm nay trực tiếp level of appellate trial in criminal cases where bóng đá hôm nay trực tiếp first instance judgment or decision has not yet taken effect and is being appealed. Cassation and retrial still fall under bóng đá hôm nay trực tiếp functions of bóng đá hôm nay trực tiếp SPC and TSPC.

Through his activities, bóng đá hôm nay trực tiếp Court contributes to educating citizens to be loyal to bóng đá hôm nay trực tiếp Fatherland, strictly obey bóng đá hôm nay trực tiếp law, respect bóng đá hôm nay trực tiếp rules of social life, and be aware of bóng đá hôm nay trực tiếp fight against crime and other violations of bóng đá hôm nay trực tiếp law.
