Regulation on decision on sentence for multiple crimes of kết quả bóng đá trực tiếp Criminal Code of Vietnam

1. Decision on sentence for multiple crimes

According to Article 55 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam on decision on sentence for multiple crimes, when a person is tried for multiple crimes, kết quả bóng đá trực tiếp Court shall decide kết quả bóng đá trực tiếp sentence for each of them and combined sentence as follows:

Primary sentence:

- If all of kết quả bóng đá trực tiếp sentences imposed are community sentences or determinate imprisonment, they shall be combined. kết quả bóng đá trực tiếp combined sentence shall not exceed 03 years for community sentence and 30 years for determinate imprisonment;

- If kết quả bóng đá trực tiếp sentences imposed include community sentence and determinate imprisonment, community sentence shall be converted into imprisonment. 03 days' community sentence equals (=) 01 day's imprisonment.

- If kết quả bóng đá trực tiếp most severe sentence among kết quả bóng đá trực tiếp sentences imposed is life imprisonment, kết quả bóng đá trực tiếp combined sentence shall be life imprisonment;

- If kết quả bóng đá trực tiếp most severe sentence among kết quả bóng đá trực tiếp sentences imposed is death sentence, kết quả bóng đá trực tiếp combined sentence shall be death sentence;

- Fines shall be aggregated and shall not be combined with other sentences;

- Expulsion shall not be combined with other sentences;

Additional sentence:

- If all of kết quả bóng đá trực tiếp sentences imposed are of kết quả bóng đá trực tiếp same type, kết quả bóng đá trực tiếp combined sentence shall not exceed kết quả bóng đá trực tiếp limit imposed by kết quả bóng đá trực tiếpCriminal Codeof Vietnam; fines shall be aggregated;

- If kết quả bóng đá trực tiếp sentences imposed are of various types, kết quả bóng đá trực tiếp convict must serve all of them.

2. Combination of sentences of multiple judgments

According to Article 56 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam on combination of sentences of multiple judgments, to be specific:

- If a person who is serving a sentence is tried for a crime committed before such sentence is imposed, kết quả bóng đá trực tiếp Court shall decide kết quả bóng đá trực tiếp sentence for kết quả bóng đá trực tiếp crime being tried and then kết quả bóng đá trực tiếp combined sentence as prescribed in Article 55 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam.

- When a person who is serving a sentence is tried for a new crime, kết quả bóng đá trực tiếp Court shall decide kết quả bóng đá trực tiếp sentence for kết quả bóng đá trực tiếp new crime, then aggregate it with kết quả bóng đá trực tiếp unserved part of kết quả bóng đá trực tiếp sentence to make kết quả bóng đá trực tiếp combined sentence as prescribed in Article 55 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam.

- If a person is serving multiple sentences that are not combined, kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp Court shall issue a decision on a combined sentence as prescribed in Clause 1 and Clause 2 Article 56 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam.

Currently, there are no documents guiding kết quả bóng đá trực tiếp combination of sentences of multiple effective judgments in accordance with kết quả bóng đá trực tiếp provision of Clause 3 Article 56 of kết quả bóng đá trực tiếpCriminal Code 2015of Vietnam. However, kết quả bóng đá trực tiếp guidance can be found at Section 5 of kết quả bóng đá trực tiếpJoint Circular No. 02/TT-LNdated December 20, 1991 of kết quả bóng đá trực tiếp Supreme People's Court - Supreme People's Procuracy with kết quả bóng đá trực tiếp following contents:

- In case kết quả bóng đá trực tiếp legally effective judgments are issued by kết quả bóng đá trực tiếp same Court, kết quả bóng đá trực tiếp executive judge of that Court shall issue a decision to consolidate kết quả bóng đá trực tiếp sentences.

- In case kết quả bóng đá trực tiếp legally effective judgments are from different Courts but at kết quả bóng đá trực tiếp same level (same district level in a province or different province, same province, same region, same military zone level), then kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp Court shall issue kết quả bóng đá trực tiếp final judgment (in terms of time) on decision on combination of sentences, specifically as follows:

+ If kết quả bóng đá trực tiếp legally effective judgments are from different regional military Courts (in kết quả bóng đá trực tiếp same or different military zones), kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp regional military Court shall issue kết quả bóng đá trực tiếp final judgment on decision on combination of sentences;

+ If kết quả bóng đá trực tiếp legally effective judgments are of kết quả bóng đá trực tiếp provincial Courts (or are of kết quả bóng đá trực tiếp military courts at kết quả bóng đá trực tiếp military zone level), kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp provincial Court (or kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp military court) shall issue kết quả bóng đá trực tiếp final judgment on decision on combination of sentences.

- In case kết quả bóng đá trực tiếp legally effective judgments are from Courts of different levels, kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp higher Court shall issue kết quả bóng đá trực tiếp judgment on decision on combination of sentences, regardless kết quả bóng đá trực tiếp time of issuance of kết quả bóng đá trực tiếp higher Court’s judgment.

- In case among kết quả bóng đá trực tiếp legally effective judgments, there is a judgment of a People's court and a judgment of a military Court, kết quả bóng đá trực tiếp combination of sentences is also carried out similar to kết quả bóng đá trực tiếp instructions above.

- In case among kết quả bóng đá trực tiếp legally effective judgments, there is a judgment from a foreign Court that has been recognized by a Vietnam’s Court, and there is a judgment from a Vietnam’s Court, kết quả bóng đá trực tiếp executive judge of kết quả bóng đá trực tiếp Supreme People's Court shall decide on kết quả bóng đá trực tiếp total sentence.
