1. What is musical work?

2. What rights do musicians have over their musical works in Vietnam?

According to Article 18 of trực tiếp bóng đá hôm nay euroLaw No. 50/2005/QH11 xem bóng đá trực, copyright includes moral rights and economic rights, which means that for their musical works, trực tiếp bóng đá hôm nay euro author will have moral rights and economic rights.

Article 37 of trực tiếp bóng đá hôm nay euroLaw No. 50/2005/QH11 xem bóng đá trựcstipulates: "Authors who use their own time, finance and material or technical facilities to create works shall have trực tiếp bóng đá hôm nay euro moral rights stipulated in article 19 and trực tiếp bóng đá hôm nay euro economic rights stipulated in article 20 of this Law."

Pursuant to Article 14 ofDecree No. 17/2023/ND-CPand Clause 5, Article 1 of trực tiếp bóng đá hôm nay euroLaw No. 07/2022/QH15 dated June 16, 2022 on amendments, musicians have trực tiếp bóng đá hôm nay euro following rights:

First, moral rights of authors include :

- trực tiếp bóng đá hôm nay euro right to name their works does not apply to works translated from one language to another. trực tiếp bóng đá hôm nay euro naming of trực tiếp bóng đá hôm nay euro works must not violate regulations.

- trực tiếp bóng đá hôm nay euro right to have their real names or pseudonyms attached to their works applies even when their works are used for derivative works. When authors' works are published or used for derivative works, real names or pseudonyms of trực tiếp bóng đá hôm nay euro authors must be specified.

- trực tiếp bóng đá hôm nay euro right to publish their works or permit other persons to publish their works is trực tiếp bóng đá hôm nay euro issuing of copies of trực tiếp bóng đá hôm nay euro works in any format in a reasonable quantity for public access depending on trực tiếp bóng đá hôm nay euro nature of trực tiếp bóng đá hôm nay euro works by authors or copyright holders or other individuals, organizations with consent of trực tiếp bóng đá hôm nay euro authors or copyright holders.

- trực tiếp bóng đá hôm nay euro right to protect trực tiếp bóng đá hôm nay euro integrity of their works; and to forbid other persons to modify, edit or distort their works in whatever form, causing harm to trực tiếp bóng đá hôm nay euro honor and reputation of trực tiếp bóng đá hôm nay euro author.

Second, economic rights of authors include:

- trực tiếp bóng đá hôm nay euro right to create derivative works;

- trực tiếp bóng đá hôm nay euro right to publicly perform their works, whether directly or via audio and video recordings or any technological devices, at a location that is publicly accessible but trực tiếp bóng đá hôm nay euro public cannot select trực tiếp bóng đá hôm nay euro time and part of trực tiếp bóng đá hôm nay euro works.

- trực tiếp bóng đá hôm nay euro right to distribute, import for public distribution by sale, or transfer of other rights to ownership of trực tiếp bóng đá hôm nay euro original or copies of their works in tangible forms;

- trực tiếp bóng đá hôm nay euro right to broadcast, communicate to trực tiếp bóng đá hôm nay euro public their works by wireless or wired devices, electronic information networks or other technical means, including trực tiếp bóng đá hôm nay euro provision of their works to trực tiếp bóng đá hôm nay euro public in a manner that it can be accessed by trực tiếp bóng đá hôm nay euro public at their time and location of choice;

+ In case trực tiếp bóng đá hôm nay euro musician is assigned to write music or has an agreement in a cooperation contract to write music for another organization or individual (trực tiếp bóng đá hôm nay euro author is not also trực tiếp bóng đá hôm nay euro owner of trực tiếp bóng đá hôm nay euro work)

Based on Article 39 of trực tiếp bóng đá hôm nay euroLaw No. 50/2005/QH11 xem bóng đá trực, trực tiếp bóng đá hôm nay euro author, who is not trực tiếp bóng đá hôm nay euro owner of trực tiếp bóng đá hôm nay euro work, has moral rights (except for trực tiếp bóng đá hôm nay euro right to publish trực tiếp bóng đá hôm nay euro product according to Clause 3, Article 19 of trực tiếp bóng đá hôm nay euroLaw No. 50/2005/QH11 xem bóng đá trực, Law No. 07/2022/QH15).

Thus, trực tiếp bóng đá hôm nay euro musician will have moral and property rights regarding his musical work if he is trực tiếp bóng đá hôm nay euro sole author of that work. On trực tiếp bóng đá hôm nay euro other hand, if an organization or individual hires a musician to write a musical work, trực tiếp bóng đá hôm nay euro musician's rights to trực tiếp bóng đá hôm nay euro musical work are exercised according to trực tiếp bóng đá hôm nay euro rental contract.
