1. What is farmland?

Pursuant to Article 10 of theLaw on vtv5 trực tiếp bóng đá hôm nay 2013of Vietnam, depending on vtv5 trực tiếp bóng đá hôm nay use purpose, vtv5 trực tiếp bóng đá hôm nay is classified into the following types:

- Agricultural vtv5 trực tiếp bóng đá hôm nay.

- Non-agricultural vtv5 trực tiếp bóng đá hôm nay.

- Unused vtv5 trực tiếp bóng đá hôm nay.

Accordingly, agricultural vtv5 trực tiếp bóng đá hôm nay includes:

- vtv5 trực tiếp bóng đá hôm nay for cultivation of annual crops, including paddy vtv5 trực tiếp bóng đá hôm nay and vtv5 trực tiếp bóng đá hôm nay for cultivation of other annual crops;

- vtv5 trực tiếp bóng đá hôm nay for cultivation of perennial trees;

- vtv5 trực tiếp bóng đá hôm nay for production forests;

- vtv5 trực tiếp bóng đá hôm nay for protection forests;

- vtv5 trực tiếp bóng đá hôm nay for special-use forests;

- vtv5 trực tiếp bóng đá hôm nay for aquaculture;

- vtv5 trực tiếp bóng đá hôm nay for salt production;

- Other agricultural vtv5 trực tiếp bóng đá hôm nay, including vtv5 trực tiếp bóng đá hôm nay used to build greenhouses and other building types for cultivation purpose, including fanning not directly on the vtv5 trực tiếp bóng đá hôm nay, or to build breeding facilities for cattle, poultry and other animals as permitted by law; vtv5 trực tiếp bóng đá hôm nay for cultivation, breeding and aquaculture for the purpose of learning, research or experimentation; vtv5 trực tiếp bóng đá hôm nay for planting and nursing seedlings and breeders, and vtv5 trực tiếp bóng đá hôm nay for growing flowers and ornamental plants.

- Use of vtv5 trực tiếp bóng đá hôm nay before the effective date of the2013 vtv5 trực tiếp bóng đá hôm nay Law(July 1, 2014);

- Having a permanent household registration in the locality where the vtv5 trực tiếp bóng đá hôm nay needs to be registered;

- vtv5 trực tiếp bóng đá hôm nay under production for rice cultivation or annual agricultural crops;

- Being certified by the commune-level People's Committee as a stable, dispute-free vtv5 trực tiếp bóng đá hôm nay user;

Thus, if individuals and households meet all the conditions, they will be granted a vtv5 trực tiếp bóng đá hôm nay use rights certificate and do not have to pay vtv5 trực tiếp bóng đá hôm nay use fees.

3. Dossier of application forvtv5 trực tiếp bóng đá hôm nay use rights certificate for farmland

To apply forvtv5 trực tiếp bóng đá hôm nay use rights certificate for farmland,households and individuals need to prepare 01 set of documents as follows:

- An application for registration and issuance of vtv5 trực tiếp bóng đá hôm nay use rights certificate, made according to Form No. 04a/DK;

- Copies of documents for fulfillment of financial obligations such as receipts of tax payment, vtv5 trực tiếp bóng đá hôm nay use levy...; documents related to the exemption or reduction of financial obligations on vtv5 trực tiếp bóng đá hôm nay and properties attached to vtv5 trực tiếp bóng đá hôm nay (if any);

- One of the papers specified in Article 100 of thevtv5 trực tiếp bóng đá hôm nay Law;

Accordingly, the time limit of vtv5 trực tiếp bóng đá hôm nay use rights certificate issurance is not more than 30 days from the date of receipt of valid dossiers. 4. Shall farmland be issued as homestead vtv5 trực tiếp bóng đá hôm nay?

Pursuant to Article 57 of theLaw on vtv5 trực tiếp bóng đá hôm nay 2013of Vietnam, the change of vtv5 trực tiếp bóng đá hôm nay use purpose is prescribed as following:

- Cases in which change of vtv5 trực tiếp bóng đá hôm nay use purpose requires permission by competent state agencies:

+ Change of vtv5 trực tiếp bóng đá hôm nay for rice cultivation to vtv5 trực tiếp bóng đá hôm nay for perennial crops, forests, aquaculture or salt production;

+ Change of vtv5 trực tiếp bóng đá hôm nay for other annual crops to vtv5 trực tiếp bóng đá hôm nay for saltwater aquaculture, salt production or aquaculture in ponds, lakes or marshlands;

+ Change of vtv5 trực tiếp bóng đá hôm nay for special-use forests, protection forests or production forests to vtv5 trực tiếp bóng đá hôm nay for other purposes within the type of agricultural vtv5 trực tiếp bóng đá hôm nay;

+ Change of agricultural vtv5 trực tiếp bóng đá hôm nay to non-agricultural vtv5 trực tiếp bóng đá hôm nay;

+ Change of non-agricultural vtv5 trực tiếp bóng đá hôm nay which is allocated by the State without vtv5 trực tiếp bóng đá hôm nay use levy to non-agricultural vtv5 trực tiếp bóng đá hôm nay which is allocated by the State with vtv5 trực tiếp bóng đá hôm nay use levy, or to leased vtv5 trực tiếp bóng đá hôm nay;

+ Change of non-agricultural vtv5 trực tiếp bóng đá hôm nay which is not residential vtv5 trực tiếp bóng đá hôm nay to residential vtv5 trực tiếp bóng đá hôm nay;

+ Change of vtv5 trực tiếp bóng đá hôm nay for construction of non-business facilities or vtv5 trực tiếp bóng đá hôm nay for public purposes involving commercial purpose, or non-agricultural vtv5 trực tiếp bóng đá hôm nay for business and production purposes which is not vtv5 trực tiếp bóng đá hôm nay for trading or services to vtv5 trực tiếp bóng đá hôm nay for trading or services; change of vtv5 trực tiếp bóng đá hôm nay for trading or services or vtv5 trực tiếp bóng đá hôm nay for construction of non-commercial facilities to vtv5 trực tiếp bóng đá hôm nay for non-agricultural production establishments.

- When changing the vtv5 trực tiếp bóng đá hôm nay use purpose under Clause 1 of this Article, vtv5 trực tiếp bóng đá hôm nay users shall fulfill financial obligations as prescribed by law. The vtv5 trực tiếp bóng đá hôm nay use regime and the rights and obligations of vtv5 trực tiếp bóng đá hôm nay users are those applicable to the type of the vtv5 trực tiếp bóng đá hôm nay used for the new purpose.

Pursuant to Article 134 of theLaw on vtv5 trực tiếp bóng đá hôm nay 2013of Vietnam, vtv5 trực tiếp bóng đá hôm nay for rice cultivation is prescribed as following:

- The State shall develop policies to protect vtv5 trực tiếp bóng đá hôm nay for rice cultivation and to limit the change from the purpose of rice cultivation to other non-agricultural purposes. In case it is necessary to change a certain area for rice cultivation to another purpose, the State shall take measures to supplement such vtv5 trực tiếp bóng đá hôm nay area or improve the efficiency in using vtv5 trực tiếp bóng đá hôm nay for rice cultivation.

The State shall adopt policies to support and invest in the construction of infrastructure and application of modern science and technologies into the areas planned for high-productivity and high-quality rice cultivation.

- Those who use vtv5 trực tiếp bóng đá hôm nay for rice cultivation shall improve and increase the fertility of the soil. They may not use that vtv5 trực tiếp bóng đá hôm nay for planting perennial trees, afforestation, aquaculture and salt production or for non-agricultural purposes without permission by competent state agencies.

- People who are allocated or leased vtv5 trực tiếp bóng đá hôm nay by the State for non-agricultural purposes and that vtv5 trực tiếp bóng đá hôm nay is currently used for wet rice cultivation, shall pay a certain amount of money under the Government’s regulations for the State to supplement the lost area of wet rice cultivation vtv5 trực tiếp bóng đá hôm nay or improve efficiency in using vtv5 trực tiếp bóng đá hôm nay for rice cultivation.

Thus, farmland can still be converted to homestead vtv5 trực tiếp bóng đá hôm nay but must meet the conditions prescribed by law and must be considered and approved by a competent state agency.
